The same way requiring public school children to have their vaccinations isn't a violation of HIPAA. The same way proving you have certain vaccinations in order to travel to some countries isn't a violation of HIPAA. Public health takes priority.
From the CDC's website:
Implications for Public Health
The Privacy Rule strikes a balance between protecting patient information and allowing traditional public health activities to continue. Generally, disclosure of protected health information without the authorization of the individual is permitted for purposes including but not limited to:
disclosures required by law (45 CFR § 164.512(a)) or
for “public health activities and purposes.” This includes disclosure to “a public health authority that is authorized by law to collect or receive such information for the purpose of preventing or controlling disease, injury, or disability, including but not limited to, the reporting of disease, injury, vital events…, and the conduct of public health surveillance,… investigations, and… interventions.” (45 CFR § 164.512(b)(i))

Although Covid passports are a horrible fascist idea they don’t violate hipaa because it only applies to medical personnel. If you foolishly choose to go along with them, then you are consenting.
If you are excluded it’s the individual companies that you need to sue

Yes, it is a violation because if they use them for what they are saying, we will need it to go to grocery shop, etc. and in the case of employees, their bosses are not supposed to have access to their private medical info. I was not happy about the fact that our medical records were online, electronic, a number of years ago, so that ANY medical person, even a nurse's aide, could access your private info, and yet, here we are-it has gotten even worse!
Yes, it is a gross violation!!!
