Let’s try this again with better context... the red dots are stop signs. Pink car has no stop sign due to a railroad being there. ?

    Why do you care? Are you fighting a ticket? Did you have a collision? Or are you just arguing over beers with your buddies?

    If you made a left turn in front of a cop and he didn't like it - guilty.

    If you had a collision when you made a left turn - guilty.

    If you had a collision when you had a stop sign - guilty.

    You'll notice that BOTH cars can be at fault here. Cop can give em both tickets and both their insurance rates can be raised.

    The pink car has the railway track as their stop sign You stop before the tracks because getting T boned by a train HURTS.[you be dead]  There SHOULD BE A STOP SIGN on the other side of the track because it is a 4 way stop.  That is just Logical.

    If the silver car reached the intersection first, stopped then started going  before the pink car reached the intersection, it had the right of way.  If the pink car got there first, it had the right of way, but a cautious driver would have allowed the silver car to go anyway if there was any doubt, especially because a turning vehicle rarely ever has the right of way over one going straight and the silver car wouldn't have known it wasn't a 4-way stop. If you were the pink car and were in an accident..FAIL.

    At no time when driving is a person excused from avoiding an accident because they had the right of way! The last person who could avoid the accident is often ruled at fault. Often when driving I have come across places where a stop sign has been knocked down and the person unfamiliar with the area would not know they should have stopped.

    What I am saying is that all drivers are supposed to yield right of way when it becomes apparent that the other driver is not driving in a safe manner.

    So yes, the pink car according to your information has the right of way. But turning traffic is supposed to make sure it is safe to do so before making the turn.

    As an old info-mercial in California said-

    "Yep, he was right! Dead right!!"

    Give me the latitude and longitude of the intersection -- otherwise I will assume that there is a stop sign before the tracks, and will include the intersection.

    Question:  who has the right of way?

    Answer:  NO ONE.  

    Read the law -- no one ever says you have the "right-of way."  The law say who is shall yield of "right-of-way."  If the other person fails to yield of "right-of-way" you do not have the right to clobber them, you must yield the"right-of-way" if you can.

    well the thing is yes I was in the middle of the intersection about to turn when the silver car decided to just gas it. I was not speeding considering I went over a RAILROAD TRACK. Also the person without the stop sign has the right of way, even though the silver car stopped the pink car still gets to go without stopping. I don’t stop because I DONT HAVE A STOP SIGN. It’s that simple people.

    If the Silver car stopped and is now proceeding through the intersection before the pink car, it has the right of way.

    Stevie Wonder can see that it's the pink car, if that's all the information available.  Did the pink car signal the left turn?  Did the silver car enter the intersection before the pink car got there?  Was the pink car speeding?
