Was Dom Lemon right that it's not illegal to yell fire in a crowded theater?

Lemon disagreed with his colleague and said that he did not believe it was an apt comparison. The two spoke over each other for a moment and Lemon said, "Chris, you’re an attorney. You know that you can actually scream fire in a crowded theater. That’s a misnomer. But we don’t want to get into that."

Never confuse legal and illegal with right and wrong.

The key is falsely yelling fire in a theater.  The phrase comes from Supreme Court Justice Oliver Wendell Holmes, who used it as an analogy to demonstrate an instance in which free speech could be limited.  The principle here is "imminent lawless action".  Falsely shouting "fire" in a theater (the "false" part is key to Holmes' formulation) is potentially illegal because you could cause a panic which could kill people via a stampede.

Yelling FIRE in a crowded theatre is illegal, despite what Don Lemon says.

And the one that screams it as false is subject to a criminal action.

I'd like to see Don Lemon yell FIRE in a theatre, if not true. And then seeing if he gets pummeled by those people.

Finally a don lemon question! Of course he's right and he says it with authoritative snarkiness. ❤ dreamboat. Isaak the bartender and his aggressive stache got nothing on don lemon.

NOT if there actually is a FIRE !

IF NOT and someone gets hurt because YOU created a condition of people feeling as if their lives were in danger and they bolted then you can be held LIABLE both legally and financially and there is a slight chance you wouldn't be and that revolves around INTENT and CIRCUMSTANCES...
