  • 2nd mortgage modification offer not good can I refuse to sign it?

    I have requested a 2nd mortgage modification. The 1st is already modified under Hamp and we've been current for the past year and 1/2. The 2nd has been less than helpful getting to this point. They are offering to take our payment down from 525 to $404 which I know I won't be able to afford. I live in CT job market still slow and we're basically living off of my husbands income and whatever 1099 work I can get. They want to bring my interest rate down from a 9 to a 5 which doesn't help me too much. I know under the Hamp program which my investor participates in, they are supposed to make these 2nd mortgages affordable so it doesn't hurt your 1st mortgage. They just called me today 5/25 said I need to sign and have my first payment in for 6/1 or they will force me to do a short sale and negotiate them getting $ from the first mortgage. My house is valued at 285K My 1st mort is 338K and my 2nd is 58K. Any advice would be greatly appreciated! I feel like I'm being bullied into this and not given any time to figure out what to do next.

    I have been unemployed for about 18 months and have fallen very behind on a title 1 home improvement loan. The bank will not work with me at this point. What will happen if they try to initiate collections on this type of loan and I'm unable to pay what they want. Thanks

  • In Connecticut, where does my responsibility end and the town's begin when it comes to tree removal?

    I have a tree outside the stone wall lining our front yard. The tree is a hazard because the town cut half the tree down about 10 years ago. It's been dying a slow death and now threatens cars parked in the driveway, and may threaten our lives as we fetch the mail or bring out the garbage. Who is responsible for this tree?

  • can I take out a hardship on my 403b?

    I need the $ for state taxes, if I don't pay by the end of the month, they will garnish my wages and take 25% of my take home pay. This will not leave me enough to pay the mortgage and have any living expenses left over. I have exhausted everything with the state as far as payments go but they will not budge. Also, I'm on a mortgage modification trial and if my payments are not submitted in time, I could face foreclosure. Will this constitute a hardship for the 403B administrators?

  • state of ct back taxes & 30 day collection notice?

    I had a business and in 2006, we owed about 10k in taxes (personal) to the state of ct. Since then the business declined and has closed. I've struggled to pay the taxes and through not getting refunds every year my debt is now about $4800. Well I just received a 30 day notice of collection which I guess means they want to attach our wages, my husband is the only one working and his salary is barely paying our mortgage. I have been out of work but looking for a job for the past year. What are my rights with this? I'm afraid they'll take so much of my husbands salary, we won't be able to live on what is left and not make our mortgage payment and pay basic living expenses..please help with any advice/suggestions you may have.

  • small claims court date with capitol one lawyers?

    I am unemployed, I have a debt with capitol one credit card and they sued me in small claims. I denied to buy some some time by asking for documentation proving the balance and the interest fees. We now have a court date and I'm out of town with family on the day of the court date. There is no way I can get out of the trip, we'll be gone for that entire week, out of state. Can I have it rescheduled? What are my rights? Thanks for any info!

  • How do I answer a civil summons for old credit card debt?

    I received a summons today for an old debt I have with Target. I feel awful about this but I have been out of work for over a year. We are barely able to make our 1st mortgage payment and still have money left over for the basics. It would be really bad if we had our income attached for this debt as we're not making ends meet as it is. How do I fight this so that they don't attach what little pay we have. I realize it stinks that I have this debt but I didn't acquire it thinking I'd never pay this back. The recession has taken a huge toll on our household and until things get better, I'm living week to week on the basics. Thanks for your info.

    I am unemployed, have been trying to find a job, my husbands check pays the basics, mortgage, oil, elec. food...the bank has threatened to turn the loan back over the the government..what happens if they do this?   • Taylor Bean Whitaker mortgage advise?

    I have a loan with TBW, the investor is Wells Fargo. I lost my job earlier this year and tried to do a home mod with TBW. Finally in August, my investor had our mod paperwork but then TBW went bankrupt so all mods were put on hold. I'm just now being told that my morg. will go to American Home Mortgage Servicers..I still don't have any info about this from AHMS. My question is. I have been holding onto my payments since TBW is gone..I am about 4 payments behind but have 1 in my bank. I desperately need a mod. I am employed now, my income is less than what is was before so the payments aren't doable for me anymore but with a mod, they would not be a problem. How will AHMS handle my missing payments? Obviously I'm scared..I've done everything in my power to get a mod but there was no on to talk to in order to get this process moving. Any suggestions or opinions on how the new mort. company will handle this situation? Thanks!

    Hi, I was in the process of modifying my mortgage with Taylor Bean Whitacker...(investor is Wells Fargo so not a Fannie Mae, Freddie mac loan) My paperwork was submitted to Wells Fargo for a loan mod...I'm self employed and business has taken a big hit this past year) Anyway I'm told now that Taylor Bean still has my loan but it will be transferred to someone at some point soon. I am 60 days behind but have been putting money in an account on the side for my mort. payment. Everywhere I read online says do not send TBW your mort. payment as it will get held up in bankruptcy. It makes me VERY nervous to not be sending a payment. They are making no attempt to collect, I receive no calls, no mail. Is this ok? until the new company takes over and gets my mod going again? Any advice please!! Thanks

    Taylor bean whitaker services my wells fargo mortgage. I have applied for a modification to see if I can get my payments lowered. I'm self employed, have been for 10 years and now that the economy has tanked, my business is so slow I can't take a paycheck. I am working to build the business back up and pay off creditors so closing is not an option for me. Luckily my husband has a steady job but we need lower payments to be able to pay for utilities and living expenses. Anyway I was hoping for part of the Obama stability plan but was told by a taylor bean rep. that Wells fargo is not participating in these kind of modifications they only mods they'll offer are to put a missed payment at the end of a loan or let you pay it back over several payments..is this true? It doesn't seem right, I believe Wells Fargo is a bank that took part of the stimulus so it would really stink if they aren't helping their customers in this difficult time...any thoughts? Also, I don't want to hire a modification company so please don't solicit. Thanks!

  • Cat's tail looks 'funny'?

    I recently noticed that our 2 year old cats tail looks strange. It is sticking straight up but the tip (about 3 inches from top - tip seems to be very skinny and seems to bend over at that point. The cat doesn't seem bothered by it but it looks strange..has anyone ever heard of this?

    we are working with the irs agent to get a payment plan. He wants us to pay 1000/month for about 7 years. I know that the penalties will still be adding up..this was a 36K bill and I've already paid about 10k towards it! anyway, I was wondering if I made an offer to clear out my 401k which has about 12K in it..would they take that and clear the balance. I'm in a hardship situation now with the economy. I'm self employed and can prove that for the past 3 years, our bus. has lost money...I barely take a salary now and have no access to any other money...any opinions on this?

  • False invoices submitted on an ar line of credit. What can the bank do to me, they are calling it fraud.?

    The bank knows about it, they don't know how much money we're out to them for as of yet. I'm going to contact an attorney and have the attorney work back a payment plan. What could the bank do to me..I have nothing, a house that is upside down, vehicles that are upside down. I'm pretty freaked out and hope someone can offer some insight. The money was not used for personal stuff, its all gone to pay vendors and employees and such. Thanks

    I have a mortgage through Taylor Bean Whittaker. I'm current and have never had a late pay on this loan. I've had the loan for about 2 years. I am self employed and with the current economy, my business has taken a big hit forcing me to reduce my salary by quite a bit.
