  • Bergen County NJ parking ticket wrong plate?

    So there is this regulation in Bergenfield that cars cannot park from 2am to 5am everyday. There isn't a specific reason for it, like cleaning or anything. I live in NY so I had no idea about this. There was no sign on the street, naturally being from NY I assumed that it's ok to park. I'm not sure how they can give a ticket so easily when there is no visible sign anywhere on the street. It's like they just expect you to know the regulation and be arbitrarily fined just because. In any case the license plate is incorrect as well as the reg exp date, and there is no other info whatsoever about the car. No vin, make, model, nada. I have read online that if you decide to contest based on being defective, they could just amend it. Others suggest if there is no info to link it to the owner, then don't pay it. I just want to know what people would do and please no snarky or rude comments about how I should pay it and all that other horsefeathers. The ticket is defective and clearly doesn't identify my car.   • How old to legally own a car in NY?

    I know that in NYS you have to be 16 to register a car, but what about owning it? Here is the scenario:

    I bought a car and the title is in my name and registered under my name. However, I would like to transfer the title only to my 11 year old sister's name, but keep it registered under my name until she turns 16. I'm young , but I like to keep my bases covered. If something were to happen to me, I would like her to keep the car, without having to deal with wills/probate, lawyers, etc. Also my mother, who is her only guardian, would be willing to sign the title application since, I assume legally my sister can't do so. I have heard of parents transferring property over to their children, so I would like to know if anyone knows about this because I haven't been able to find anything concrete. The DMV doesn't specify whatsoever, a minimum age for car ownership, only for registration. Any insight would be appreciated and a million thanks in advance!

  • Is being gay a trait?

    I was thinking about this since I was reading up on the subject. I completely agree that people are born with their sexualities and they discover it usually around puberty or in extreme cases much later in life. People say there is a gay gene, however I was thinking what if it isn't a gene, but a trait like eye color. For example, let's say that your mom has green eyes and your dad has blue eyes. You could be born with one or the other, or even none at all because you could have the eye color of one of your grandparents. So what if, when your mom's DNA and dad's DNA are combining and you're a boy you get your mom's heterosexual trait making you attracted to men and if you're a girl you get your dad's heterosexual trait making you attracted to women? Also it could be a combination of both. I think it's an interesting theory that can't be ruled out unless there's some serious scientific evidence against it, which I doubt there is since people only started seriously studying sexuality as something innate recently. Any input would be appreciated, but please nothing offensive or biased, just some insight or evidence would help. Thanks!

  • What is considered original research in a term paper?

    I signed up for this anthropology class as one of my required electives and when I was reading the course description it says that you have to write a term paper with original research. I'm not exactly sure what that means, could it be they want us to go out there and interview people or something or is it something else? Also this class is combined with a graduate section, is there a reason why they would put grad and undergrad in the same class? I would appreciate some insight before I decide if I should take it or not I always opt for the easier classes for my electives.

  • Complaint against landlord?

    I was wondering if it was possible to file a complaint against my landlord for refusing to allow other cable providers in my building? I live in Manhattan and people across the street have Verizon FiOs, directv, dish network and even RCN. People in my building however are stuck with time warner cable. They are eating us ALIVE!! The service is extremely overpriced, it sucks and they don't give any promotions to existing customers. Everytime they advertise on tv they always have this triple play for $99 and what not, however current customers aren't allowed the privilege. I already had to disconnect the phone, my dvr, and return a cable box just because of their ridiculous fees, I pay $130 right now and my aunt pays the same as me with fios and has 4 boxes and the triple play. The good thing about verizon is that they always give you promotion so you stay with them, twc could care less if you leave. trust me i tried, when i returned the boxes and the phone service they would not compromise. I could be paying less than $50 with dish or directv and have access to so many channels. Anyhow, I have contacted verizon dozens of times they insist that my landlord won't let them wire up the building for fios even though we could get regular dsl and phone service. Could i file a complaint with the fcc or something because they allow a monopoly on us, we are at the mercy of twc and I need my internet service for work and school. Thank you for your answers!

  • Getting back down payment for car?

    I wanted to buy a 2005 Ford Explorer and I was counting on having the vehicle financed, but considering that it would be financed my insurance would raise my premium considerably and I would prefer to buy the car outright. My insurance gave me a decent rate but I don't want to pay that on top of a car payment. Collision coverage is expensive and I don't really need it for an older car unless I finance it. I only usually carry comp which covers glass, theft etc. I don't have all of the money now, but maybe in 6 months or so this way I can be the full legal owner and not be required to have full coverage. The thing is that I made a down payment of $1000 and I don't want the car unless i buy it cash. I should be able to get my money back because I did not sign a single piece of paper and my loan hasn't been approved yet, i want to withdraw my application. When I called the dealership they tried to convince me at all costs to buy the car and even change my insurance company. I told them that it wasn't the case because either way I don't want the car anymore. I was a bit iffy about getting the car financed but I gave it a shot just in case I got a decent payment. I just want to know what steps I can take if the dealer gives me a hard time to refund my down payment which i paid with my debit card not cash. I assume that I could do a chargeback with my bank if they don't refund it, but would that affect me? Again I did not sign a single piece of paper saying that I agreed to buy the car or get the loan. Also the down payment was for the loan not for the car so technically I think they could still sell it to someone else anyway. So I assume that they cannot say that by making a down payment is the same as signing a paper agreeing to buy a car. Please correct me if I'm wrong. Thank you.

  • Insider payment before bankruptcy?

    I am helping my mother file for bankruptcy and we are going to consult a bankruptcy lawyer since the consultation is free but I am trying to gather as much info myself before we do so because we don't trust lawyers, especially here in NYC. I was reading and found out that the trustee can go after payments made to creditors 90 days before filing and up to a year if it was to a friend or relative. My mother owed on my credit cards around $4000 which she paid with her income tax refund in February. This money was not for me, she deposited into my account but I immediately applied it to the credit cards. So I want to know if the trustee will come after me or after the credit cards which is a problem either way because if she owed that money and she paid it then this is a really stupid law. I would understand if she gave the money to me personally as a gift to be "preferential" but clearly I didn't enjoy a dime if I had to pay it forward. The reason I want to know who they will go after is to see if we have to wait the 90 days or the year before filing. I realize that I can ask this to a lawyer but I would like to find out this information before hand and just confirm it with them instead of having to hire them just so they could tell me more, they only tell you limited stuff in these free consultations anyway, and we cannot afford a lawyer because if we could wouldn't consider bankruptcy. Also if push comes to shove we'll leave everything as is and just ignore the phone calls she's judgment proof anyway we just want to file bankruptcy to end the harassment and if they make it too difficult it won't even be worth it. I don't think people should be penalized for trying to do things the right way because at least she used that money to pay off some debt instead of going on a shopping spree like some people do.   • Can a creditor sue you twice?

    Bank of America (they can go to hell) they already obtained a default judgment against my mom for about $4000. This was a year ago and today she was served again, this time with a different index number. They are clearly suing her twice for the same debt, and on this summons there is no indication about the previous judgment. If they already have a judgment are they allowed to sue her again for the same exact debt? If they aren't allowed to do this can we use this to countersue or get the case dismissed? They can't do much since my mom was laid off and is only making now a little over minimum wage. Thanks in advance!!

  • Are family member assets exempt in bankruptcy?

    I am trying to help my mother file for bankruptcy and we clearly cannot afford to hire a bankruptcy lawyer. I know that when you file for bankruptcy they take away certain things so I know they will definitely take my mom's car. My concern is that I cannot find anything on family members assets. I know that my car is exempt because it's under my name. I read that you can get to keep like one computer, one tv, one cellphone etc. This is where I am worried because if she files for bankruptcy I don't want them to come to our apartment and take all of our stuff because me my brother and my sister each have a phone and a computer. There are 3 tvs and 3 air conditioners one stove one fridge and one dishwasher. The problem is that i paid for all of these things with my own money but how can i prove that these things all belong to me if i don't have many of the receipts especially since i bought a lot of them more than 2 years ago? My mom was laid off and is only working part time at crap over minimum wage so they don't garnish her wages, this is why she fell behind on her payments. I owe some money in my credit cards but I pay my bills every month so I am ok however I don't want them to want to sell all of our things for my mom's debt. I am still paying off some things like the appliances and computers so if they take them away I'm sure as hell not going to pay back what I owe and I will be sure to let any judge know that. Two creditors already obtained judgments against her and they haven't acted on them yet. If anybody has any info about what may be some possible options please help, we live in NYC.   • Cannot get SSN for non resident alien spouse?

    I am trying to find this info out for my aunt who is a U.S. resident currently trying to become a U.S. Citizen. She got married and her husband is a non resident alien, according to the SSA, non resident alien spouses do not qualify for a SSN. She does her taxes early in January and wants to start applying as early as possible for this. According to the IRS website NRA spouses qualify for an ITIN, however under where it says "How do I know if I need an ITIN?" it says that "By law an alien individual cannot have both an SSN and an ITIN." This is where the problem arises, If they get him an ITIN now as she needs it for her taxes but later when he gets his green card he will need a SSN, since an ITIN is not valid for work, how can they apply without breaking any law? Because unless I'm crazy and I don't think I am lol, these laws seem to be contradicting each other. They always say that it is better to apply for a SSN first but that would be a waste of time since they won't even accept his application and she cannot file single or married filing separately since now you HAVE to have an ITIN or SSN and cannot leave it blank or write NRA like before. If anybody knows whats the best way to apply for this please explain it to me so that I can tell her what she has to do. Thank you guys in advance!!

  • Include child on K-1 Fiance petition?

    I need this info for my cousin who is living in DR and his girlfriend is going to file a fiance petition for him. They would've gotten married but we hear the fiance visa was faster. The thing is that my cousin has a 2 year old daughter but her mother (who only spits venom out of her mouth) was married at the time of birth to her current husband. Now my cousin's daughter was legitimated by her husband and has his last name even though he knows she's not his daughter. Which leaves us wondering, the petition says to include your children even if they will not come with you (she and her mother are immigrating to Spain) would the consul deny my cousin his fiance visa just because he won't bring his daughter or because she doesn't have his last name? FYI, my cousin and his girlfriend are really paranoid right now and just want to make sure that they won't have a delay in their case for something so unimportant. Please let me know if you have dealt with the whole fiance visa petition and if there are any problems this might bring. Thanks!!

  • Biometrics appointment then test interview?

    I filed my grandmother's N-400 on December 4th, 2010 and she received the receipt notice the first week of January. A week later she received the biometrics appointment for the 27th. In my opinion the application is moving pretty fast, they say the average is 5 months. I just want to know how long after the biometrics appointment will she have the interview. Please specify between receiving the interview appointment letter and the date of the test. We want to be optimistic that she will have her certificate by June or July, because we will be traveling to DR and want to make sure that the process will not extend beyond that. That way she can travel with her Dominican passport and get her US passport in the consulate in Santo Domingo in a few days, in order to get back in the US. Passports are taking a month to process here in the states, which is way too long. We live in NYC by the way and she knows all her questions and has no other eligibility issues.     I'm really excited because I just got my CDL Class B permit the other day. I live in NY and I know that you have to be 21 to drive a school bus. The thing is that I took and passed the written tests for the air brakes, passenger, and school bus endorsements. What I need to know is if I have to be 21 to take the road test in the school bus? I am thinking that I can because why would they have let me get the S endorsement in the first place if I am under 21? Maybe you only need to be 21 to drive a school bus with children, and not for purposes of driving it for a test. I have called the DMV and they all give me different answers, I need to know if I can take the test in a school bus and not look for work as a school bus driver until I am officially 21. Please answer if you have any idea what can happen. I am 19, the permit is valid for 1 year and expires 2 months before I turn 21 so just in case I am not able to take the test in a school bus can I renew the permit without having to take the written tests again?   • Claim siblings for 2010 taxes?

    So I claimed my little sister last year and my mom claimed my brother because we both kept up the cost of household expenses 50/50. This year however my mom got laid off and is on ui benefits. I was reading on the IRS websites and I came to the conclusion that I can claim both my brother and sister because my AGI was considerably higher than my moms and all her income was unearned because they were ui benefits. Unfortunately it looks like I can't claim my mom because she made over 3650, I want to know if there is an exception to this rule. I paid the rent, cable, internet, phone, credit cards, etc. My mom is only getting 95.00 a week which is scrap money. I made 300 to 400 a week. Since I claimed my sister last year I shouldn't have problems but I heard the IRS loves to pick out returns if you claim more than one dependent, I really don't care if they audit me because I don't have anything to hide and they are my qualifying relatives, however we need that income tax refund pretty fast and wouldn't want a delay.   • Buying a house for someone else in another state?

    I want to buy a house for my mother in Georgia and we currently live in NY. I have recently checked my credit and looks like I should qualify for up to a 60K house. I saw some pretty decent houses for under that price. I just want to know if I can buy the house and have my mother live in it. I was also considering renting a part of it to my grandmother who has a fixed income. I don't pay rent, have debt or any other major expenses. Just food, transportation, and cell phone. I'm pretty sure that I should be able to do this since I will keep living and working in NY. I want to hear other people's opinion about it and what terms will the bank place for the mortgage.   • Do I have 100 amp or 200 amp service?

    Currently, I have a panel with 5 breakers and 3 free slots. Three of them are 20 amps and two are 15 amps. I want to have a dedicated outlet for each of my two bedrooms for the a/c's. I called my buildings maintenance office and they are sending out an electrician in August to see what they can do. I want to know a little of what might happen beforehand so I won't be as disappointed if what I want isn't possible. My electricity is included in the rent so it's not like I can call coned and find out what service I have. What's curious is that my panel doesn't have a main, I know its usually at the top. I live in a building in Manhattan, NY. I need to know if apartments here in NY usually service 100 amps or 200 amps. I did the math and unless I have 200 amps of service I won't be able to get the additional outlets even though I have the space. I know that some people have more breakers than the total amps because they don't use all circuits at the same time but I do. I have 3 tvs, 3 a/c's plus all the lights, washer, fridge, microwave and stove. All the tv's and a/c's are always on but cannot use them all at the same time or the breaker will trip. I would love to be able to have them on without worrying about the overload. Also is it possible that the electrician can rewire an existing outlet into another breaker with the higher amperage?   • Traffic violations on new NJ license?

    Recently, I and about 6 other cars were pulled over for "shoulder riding", I really had to go to the bathroom so I decided to get out of my lane into the gas station about a quarter mile away. I was going to fight the ticket in court because the judge might have pity on me and my little sister who had just finished two large icees on a really hot day. The fine was only $85, so I decided to just pay it. The thing is I'm planning to move to NJ in less than a year from now and I wanted to know if that violation will show up when I switch my NY license over to NJ. I really didn't want to surrender my NY license in the first place because they don't record out of state violations(except for Ontario & Quebec) and the DMV in NY is A LOT easier to handle than in NJ. If the violation does appear it will most definitely affect my insurance premium. I'd rather just keep my NY license and leave things the way they are and stay on my mom's policy. I heard you can still keep the license of the state you work or go to school in. So even if I live in NJ, I will still work and go to school in NY. Thanks in advance.
