  • 2004 Sebring LXI; Check Engine Light is on, transmission is not wanting to shift?

This is a strange problem. On Friday, I started up the car just fine, drove about 2 miles, and stopped for just a moment (less than 10 minutes). Came out, started up the car, started to drive away, and as I was accelerating, the car started to buck...basically what you see when someone driving a stick shift is having trouble shifting properly. Along with this the check engine light came on. I was able to get the car home; no overheating, it didn't die, and I didn't smell anything burning, and there was no smoke coming from under the hood. We checked all the fluid levels (the car just had an oil change 500 miles ago, and I only drive it maybe 20 miles a day), and everything was fine. Earlier last week, I was driving it to work, and it jerked so hard I thought I had been rear-ended, and the CEL came on. It still drove the rest of the way just fine, and made it home later that day with no issues; no overheating, no smoke, nothing. The code on the computer read as "undetermined". Any clue what it might be?

  • Employer appealed unemployment-changed story during hearing?

I was terminated back in October, alledgedly for misconduct; they claimed I tried to falsify the drawer report to cover a short, which wasn't true...I had noticied the short and called the GM, who TOLD me to void the order that caused the short. I was approved for unemployment, as the state said they failed to prove misconduct. My ex-employer appealed this (of course), and when I received the paperwork from my UI file, it pretty much backed up what I had told them during my initial review...that I was let go because of that incident. They didn't present any new evidence, and I never received anything before my hearing, so I prepared based on that. I had only had one performance review, where nothing bad was said, and I even got a raise.

So, this past Tuesday, I had the appeal hearing. The GM who let me go showed up (wasn't notified he'd be on the call), and he proceeded to tell an ENTIRELY different story than what was in the paperwork; primarily that they had "noticied" questionable voids in the past (I'd only worked there 5 months), that I had been coached on these (even though that wasn't their policy...their policy said unverifiable voids are an automatic termination), and that they had continued. He presented NO documentation of ANY of this, probably because it didn't exist. I objected to the testimony, mainly because nowhere in any of the statements or paperwork they submitted had they laid this out, and had I known they were going to go this route, I could've provided documentation refuting this. I DID ask that the separation statement (which i didn't sign), be admitted into evidence, as it stated that there was only one incident that caused my termination.

My question is this: Did my ex-employer basically sabotage himself, by turning it into a matter of performance rather than misconduct, and by not submitting ANY supporting documentation of his claims?

  • Followed manager's advice on short drawer and got fired?

I was working the late shift at my last job, and discovered when closing out my drawer that it was about $35 short. Because I worked at Wendy's and they automatically fire you if you are more than $20 off, I panicked and asked the GM what I should do. He told me to do a void/refund for the amount i was off, and bring it right. I did so, but 5 days later I was called in and told I was being let go for being short, and also accused me of altering company documents and fraud. I stated that I didn't steal ANYTHING, and that I simply did what the GM told me to do. They also said that the slip tha we are supposed to put under the register when we do a void/refund was missing...I put that slip there like I always do. Anyway, I filed for UI and was eventually approved, however, the employer appealed it...do they have a case? During my eligibility review, I told them exactly what happened, my former employer sent them all the paperwork including the policy and I won. They have sent in no new information other than a letter saying that they called me in the day AFTER it happened, which isn't true...it was nearly a week later. How do my chances stand?

  • Do you have the replace the door if an electric window won't roll up?

The other day, I closed my car door on our 2000 Focus Wagon, and the window glass fell down into the door. I was able to work it back up, and kinda jimmy it into place, but I've been told if you have electric windows, you have to replace the entire door in this case?? Is this true?
