Uninsured Motorist and Breach of Contract?
I'll try and summarise my situation. I'm from the UK and when in Florida last July, a vehicle ran into the back of me as I sat stationary at a stop light. I suffered whiplash and had 9 months of physio and pain medication. After that i was fine.
My US attorney (appointed by my travel insurance company) has told me that as I don't have permanent injuries, I can't sue the driver who ran into me for pain and suffering and he has closed the case. The "no fault" system in Florida means I have to seek recompense from my own insurance company under PIP insurance, but that would only cover medical expenses.
He then said the following....
IF YOU HAVE UNINSURED MOTORIST COVERAGE UNDER YOUR OWN POLICY, THIS IS REALLY A BREACH OF CONTRACT CLAIM. GENERALLY SPEAKING, WITH A BREACH OF CONTRACT CLAIM, THE LAW WHERE THE CONTRACT WAS MADE GOVERNS. EVEN BETTER, YOU CAN GENERALLY SUE ON A BREACH OF CONTRACT WHERE THE CONTRACT WAS MADE AND NOT NECESSARILY WHERE THE ACCIDENT OCCURRED. THUS, YOU OUGHT TO TALK TO YOUR LOCAL ATTORNEY AND SEE IF THEY CAN BRING A SUIT WHERE YOU LIVE ON THE UM PART OF THE CLAIM-IF SO, IT MAY BE THAT UK LAW APPLIES AND NOT US LAW.
One thing that is confusing me is the bit about uninsured motorist claims and breach of contract.
Firstly, all 3 drivers involved in the accident had motor insurance. So I don't understand why the Uninsured Motorist coverage is relevant.
Secondly, even if I was covered for Uninsured Motorist coverage, why does this become a breach of contract claim ? Can anyone explain this to me in non legal jargon please. Can sue the driver who hit me for breach of contract ? Or is he suggesting I can sue my own car hire insurance company (Alamo) for breach of contract ? Why would they be in breach of contract ?

I'm about to begin legal proceedings for personal injury against the driver of the car who ran into me.
My question is in cases like this in Florida, what would be a typical contingency fee percentage that an attorney would ask for.

My friend bought a no expiry ticket in 2004 and only used 2 of the days. He hasn't been back since and has offered to give them to us for our trip in June this year so we can use the remaining days.
I've been told that the biometric scan security system that stops tickets being transferred to other people was only introduced 2 years ago, so does that mean that we will be safe to use them ?
What checks were in place in 2004 that stopped this practice from happening ?
As no biometric reading was taken, what will happen when I put these tickets in the ticket machine.

My friend has a 10 day no expiry ticket for all the Disney Orlando theme parks but he's only used 3 days worth. He now has no intention to go back whereas we ae going there next month.
So my question is....if my friend gives me his no expiry tickets, will I be able to use them to gain access to the parks ? I'm not sure if his name will be on them, or if I have to provide some form of ID at the park entrance to prove I'm the rightful owner.

I live in Scotland. My local Tesco uses a parking enforcement company to monitor their car park. Recently I parked in a disabled bay as their were no parent and child spaces remaining and the weather was really bad. I came back to find a parking ticket on my windscreen.
However, the Car Registration number on the ticket is not mines. They put a 5 instead of a 0. Also, the tax disc number is illegible. They made a mistake and tried to overwrite one of the numbers so its not clear.
If I ignore this ticket, they say they will write to the DVLA to ask for my name and address and they will then take me to court. However I'm not sure how they can link it to me if the reg number is wrong and the tax disc number is questionable.
If this went to court, what would my chances be of getting away with this ?

My wife doesn't like spicy curries whereas me and our friends do. Up until now, I've been making Indian curries with one green chilli finely chopped but with seeds removed. Thats spicy enought for my wife, but its a bit bland for the rest of us.
So I was wondering whats the easiest way to make it nice for all of us and I was thinking whether or not this would work..........
What if I continued to do what I currently do, except maybe 10 mins before serving the curry, I could split the curry into two pots, and add the green chilli seeds into one pot.
I'm not sure if 10 mins is enough time to let the chilli seeds release their heat.
My wife isn't into creamy curries so adding natural yoghurt to cool it down isn't an option.

If I'm connecting two lengths of JG Speedfit pipe using a JG Speedfit connector, do I need to use JG Speedfit pipe inserts ? I was under the under the impression that you only need to use pipe inserts when connecting to a compression fitting, but a local plumber merchant says you always need them.

My friend has a full set of golf clubs yet uses only his driver, chipper and putter (and sand iron if in a bunker). He uses his chipper in place of any normal iron, regardless of how far he is from the hole i.e. if he's 180 yards, instead of using a 6/7/8 iron like any normal golfer would, he'll use his chipper. If he's 90 yards out, he won't hit a wedge, he'll hit his chipper. He uses it from the tee on every par three.
My take on this is that it's very similar to the current row over UK MP's expenses. He's not breaking any rules, but it goes comletely against what he "should" be doing. It's a complete kick in the face to everyone who has tried to learn the wonderful game of golf using every club in the bag.
So my question is this.......am I alone here ? Or does public opinion agree that chippers should be banned unless they are being used within 10 yards of the green ?
Thoughts/comments/suggestions of what should happen to his chipper are most welcome. Thanks.
14 AnswersGolf1 decade agoOther than a leak, is there a legitimate reason why my pressurised heating system won't go above 1.5 bar ?
My house is 18 months old and we were having problems with the water pressure. The plumber said that 1.5 bar is the lowest it should be, going up to 2.0 bar when the heating is switched on. But 1.5 ios the highest we can get it, even when switched on. Sometimes it drops below 1.5, but when I open the top-up valves, it goes to 1.5 then stops.
Leak sealer has been put in to rule that out, but its still the same.
Why else would it not go above 1.5 bar ?
