Parents, Have you ever been refused to remove your child from?

Medication?

okay a little background information
My son has been on several medications for adhd among others over the past several years, with nothing really working for him in a long term effect.
My son is in a state faculity for children for behavior problems.
My son has been there for over a year now.
He was started on ritalin and ambify.and over the last 8 months we all , faculity and we as his family have seen very signaficant changes to the good.
Well then the fauclity changes docotrs and in his first meeting with the new docotr the doctor changed all of his medications, in fifteen minutes we now are starting all over.
New medication Strattera and Tegretol xr
Well my son has been on strattera before for 9 months with no effects happening for him, nothing changed with behavior , attention, focus, ect.
I have done some reading and the Tegretol has many side effects and my son has never been good a a xr tablet in the past. I do not want my son taking this medicine.
I wrote the doctor a letter and requested he be put back on the medication he was previously on and that was working very well for him. He has refused to do that. The doctors first statement of why he was changing his meds were was ritalin was going off the market, when no information could be provided that ritalin was going off the market , he then made a statement that he was taking all the youth in this faculity off of stimulants..

My son has never had the postive reaction to medication as he had with what he was taking, it was workng for him very very well, and this is even noted by the center he is placed in and they also agree with me, and the one that told me to begin the process. (which i would done anyways) Myson was set to be released in the coming months as well, like in two months because he was doing sooooo well.
Now my questions -----
Have you ever experienced a doctor refusing to listen to your request?
What are our rights as parents for type of experience? And can a medical professional make a general refusal to give children these stimulants based on his preferences versues what is in the best interest of the patient?

Any help would be greatly appreciatted.
I know i may have speeled alot wrong but i more worried at this point about getting information versues my spelling ... so please ignore , i am distraught over this right now.

I do have rights to my son, and the center does agree with me but this is the doctor the state has contracted with to take care of these children so no at this point i can not take him to another doctor.
I did not send him here, the courts did because he got into trouble with the law. I am very much in contact with the center, and they are on my side. But cant really do anything and is sending me the grievence papers to file .
So at this point i cant get him out , but will contact a lawyer to fight this if need to be. I am just trying to get all my information complied before calling a attorney on monday .

Welcome to the wonderful country of Bureaucracy. I know what you are going through. You can't force a doctor to prescribe medication. You can only switch doctors and if the state is paying the bill you really do not have much say.

There has to be another doctor in the employment of the state agency supervising and reviewing this doctor's treatment. Someone at the institution should be able to tell you who that is if the doctor themselves won't. You can try talking to them but once again they can't order this doctor to change their treatment they can only try to persuade them.

Getting a lawyer and going back to the judge that originally ordered the placement is the best bet. The only problem is that probably the best the judge can do is order him placed somewhere else which may be further away from you.

I know your son's problem is a heartache for you but try to take care of yourself. Stressing out about things you can't control only hurts you. And the stress can have actual physical effects on you. Since you can't meet with the attorney until Monday try going for a nice long walk and watching a movie. Remember you can't be strong for your son unless you take care of yourself.

I would say it's just a bit of misunderstanding with this doctor. You demanded your son be off this medication, he thought you were saying you felt he should be off and he disagreed. I think if you just tell him your son will not be taking this medication anymore, then he will find something else.
This said I think the only case where I have seen doctors go against the parents wishes legally is when there was a life threatening condition. For example parents refusing a life saving blood transfusion for religious reasons have been told off in France and two siamese girls from Britain were separated against their parents wishes because they would both have died if it hadn't been done (the separation though would certainly and has killed one of the girls). If quitting a medication is gonna end your child's life or disable him or something serious like that, they can ask for a judge to rule against your wishes. However in your case, you can chose.
Actually with all these medications failing have you considered that your child may have been incorrectly diagnosed with a behavioural condition? Or that maybe none of them work so you just have to deal with it naturally?

EDIT: just saw your additional details which makes my answer completely irrelevant now. Maybe the staff of that center can back you up. Otherwise, I'm out of ideas. I'd just remark that although they court ordered your child in that place you still have legal custody, right? That means I think that you should still have a legal right to refuse the medication this doctor is giving you. He might go to court saying you're not being cooperative but from what I understand the staff would back you up and you can easily defend your case with your child's medical history.

Is it court ordered that your son stay in this facility? Why are they treating you like you have no rights over your own son? Is there a way you can just get him out of there now and get him to a private dr?

Get a second opinion! Appeal to whoever you need to appeal, just get your kid OFF Tegratol! My mother was on Tegratol for *years* and it changed her in a bad way. Do whatever you can, just get your kid back on the meds he was on as fast as possible.

Hell, even if you can get him out of the state run facility! Did you put him in there in the first place? Cause if you voluntarily signed him in, you can take him out AMA, and get a better doc, I think.
