It's the commodity that's being sold.

Beer is legal. But selling beer to someone under 18 is illegal.

Cigarettes are legal. But selling cigarettes to a minor is illegal.

Guns are (generally) legal. But selling guns to a convicted felon or to someone judged mentally ill can be illegal.

Percodan is legal. But selling Percodan to someone without a prescription is illegal.

Again, it's both the commodity and its sale--and sometimes the nature of the purchaser--that defines legality or illegality.

Incidentally, not all selling is legal . . . at least not without a license. You can't sell rides in your car without a taxi license. You can't sell alcohol to the public without a liquor license.
