If a husband refuses to buy his wife's medication,as a form of payback,and she dies as the result, could that be viewed as murder ?

I am on low thyroid medication, and my husband has hinted that he does not have to buy my medication. I depend on him for buying my medication, which is 4.00. I have been without it for almost two weeks, and when he is able to buy it,m it will be little over 3 weeks. We argue over his online "friends," and he is passive-aggressive. He is also immature in some things. Every time we argue, and I have made several points, ( in which he always says he is innocent thereof) then he pouts ad sulks like a wounded bear. So,if i die because of not having my medication ( heart attack is very likely) is that considered murder ? And is withholding medication that I need to live with, considered abusive,or am I being over-dramatic ?

Legally that's a complicated issue.

If he is your legal guardian, then he is obligated to care for you, and can be charged if he fails to do so. If he is not- which if you're a legal, mentally competent adult, will be the case- then it's more complex. Generally speaking, people do not have any obligation to help out or save anyone else, but the courts have ruled in the past that spouses may have at least some obligation to help each other.

Why exactly are you unable to buy it yourself?

Does your pharmacy deliver, or is there one close by which does? If yours doesn't deliver, then find out who does, and have the prescription transferred to that pharmacy.

In the alternative, have a friend or relative take you to get your medication or pick them up for you. Most people we know are willing to do favors for others.

call CPS. There is such a thing as invalid/elder abuse, so I'm thinking there is also a classification for spousal abuse by refusing medical treatment, and you need to get out f that relationship. There are still battered women shelters, you know.

Heart attack is not very likely. Maybe if you go without it for years, but not just a couple of weeks. And it's not murder, because he is not obligated to buy it. You can buy it for yourself. That is what most adults do.

Why don't you buy your own? Are you handicapped and cannot move? He sounds like a douchebag and you sound dependent. Both of you have issues.
