I got doored while on my bicycle, drivers lawyer filed for motion to dismiss how likely will his lie get my case dismissed?

He is stating that his uber passenger got out without his knowledge, he is lying because he told me different that day, I got broken ribs and spent a night in the hospital, I have spine damages also that cause numbness and back pain, my lawyer said he's fighhting it, I was in legal standing in where I was riding my bicycle, he was in the driving lane when he let his passenger out

When you get to Court be SURE to call the Judge and opposing attorney "dumb idiots" and see where that gets you.

That is neither a lie OR a defense. On the other hand, you DID NOT break your ribs riding a bicycle into an open car door. The injuries you claim require an impact greater than you would have received. Additionally, what you claim requires YOU were operating the bicycle in violation of traffic laws.

Why is the driver responsible for the actions of his passenger? The passenger opened the door, not the driver. You are going to lose this case because YOU are lying. You didn't hit the driver's door - the only door the driver is directly responsible for opening - you hit the PASSENGER door.

Its easy to sit and tell a lawyer a lie,  go into court and most of us will fall under cross examination.
My one concern would be,  if you are riding at a safe distance and speed and a car ahead of you stopped,  why did you not put space between you and him as you were about to pass.   All you can do if let the case run.

Bicycling 101: Be cautious when passing a car stopped at the curb.

If your overtaking manoeuvre was "legal" , it sounds unlikely that the driver could avoid responsibility ?
