I got doored while on my bicycle, drivers lawyer filed for motion to dismiss how likely will his lie get my case dismissed?

He is stating that his uber passenger got out without his knowledge, he is lying because he told me different that day, I got broken ribs and spent a night in the hospital, I have spine damages also that cause numbness and back pain, my lawyer said he's fighhting it....

I have to add more details because a bunch of you people are serious negative humans... I was riding in a legal area, the driver was in the driving lane not pulled over next to curb, I had no time to stop because its was just perfect timing, and tthis extra detail doesn't even matter because the question is the fu***** question.. oh and some idiot before said I couldn't of broke ribs from tthis impact lol I got rushed too the hospital and it was confirmed literals 1 hr after the accident I had broke 3 ribs...

One of those attorneys, by the way, was retained to represent YOU, and that attorney is more knowledgeable about the case than strangers on Yahoo. The lie that is this question WILL NOT prevent your BOGUS case from being dismissed.
There is NO WAY you hit the door hard enough to sustain the injuries you claim.
There is also NO WAY you hit the door AT ALL without operating the bicycle in violation of traffic law.
If the event you describe happened at all, the Uber driver has a case against YOU for damage to the door.

the critical question is likely to be "were you in your proper lane"?  if you were in a bike lane, you likely have a case against someone ... if you were in a normal street lane, you likely have a case, ... but if you were on the sidewalk or between the travel lane and the curb, you are likely to lose because you did not have the right of way -- the pedestrian who opened the door had the right of way

It will come down to which party is more believable - you or the driver or possibly the passenger. For that matter, I fail to see how what the driver said or didn’t say or knew or didn’t know matters. HE was the owner of the car. HE is at least partially liable. It’s just that simple.
