Anyone have sudden acceleration with their Kia car?

This is a long story....My husband and I bought a 2004 Kia brand new in 2004. Well about a year later my husband was driving and we were heading to his sister's house and we stopped at a gas station. When he stopped the accelerator suddenly got stuck and it took all he had to make it stop. Finally I just turned the car off before it blew up. Well we got it "fixed" and then it did it again at a parking lot not even a year later (just this past month). So we just told them we wanted to trade it in for a newer one. So we got it about 2 weeks ago and guess what???? It is doing the same thing (this time at Burger King in the drive-thru. So needless to say we are furious!!! My husband called the Kia place we got it from and they are supposed to call us back tomorrow to let us know what they plan to do. Should we go ahead and get a lawyer to see if the lemon law applies to us? Has anyone experienced this?

Thanks I am sure we would have to give them 2-3 times to fix it here in Alabama too. Since we traded the other (a 2004) in for a new car (a 2006) then I guess we will just have to wait and see if they really fix it. I hope so so we can avoid court or whatever altogether. What worries me though is that this is the second Kia Spectra that has done this so what if it happens to someone else and they get hurt or die from it. Shouldn't they have to look into this?

    Most states do not require a lawyer for lemon law enforcement. You to your states web site for DMV or RMV.
