Contact a Lawyer. The easiest thing is to make sure it is stipulated in the Will. Do you have a Will?

That will most likely be a custody case - it would be safest to make the person already legal custodian before the mother dies.
That will be most respectfull to the mother. You could also opt for adoption - but I think the procedure is more difficult and there are countries (like the nehterlands) that refuse people the right (even in such cases) to chose the adoptive parents.
Which is rediculous.

Get with a lawyer and make provisions in your will. Notify the ones you want to have custody and make sure everything is taken care of before death.

Its called a will. Included in it is the "provision of care section" that you want. Its specific wording would vary depending on where you are.
