When a soldier gives up and is captured is he considered kidnapped or a POW?

When a soldier surrenders or is captured he is considered a prisoner of war. The international law of war would hold that he is a POW and is entitled to be treated accordingly. After prisioners were held to be not prisoners or war but terrorist detainees by the US perhaps the rules don't apply to Arab provisional military groups like Hezbollah.

I believe he is a POW. unless the captors make demand of some one or a country for something in exchange for his release. Then I would consider him a kidnapped,pow.

a POW is a prisoner of WAR. this means war should be declared BEFORE the soldier was taken. anyway, the militias are not armies and Therefore they don't answer to any government, and they don't recognize the 4th Geneva convention (they orchestrate attack that are deliberately aimed at civilians)
