Ebay item arrived damaged. Seller wants me to file claim. What should I do?
Hi all,
I bought a pricey computer off ebay. It was used, but top of the line. I paid 1300. Computer arrived totally beat up and non functional. It was improperly packaged (although I haven't told FedEx).
I tried to get FedEx to work with me on a claim, but the run-around is hilarious and never ending. Everytime I call I hear something new from some surly rep, and everytime I have to start over... It's been over 3 months. The last time I called they told me they work only with shippers, not the recipient. They will not work with me, and I cannot see them filling any portion of the 500 dollar claimed value the seller insured for.
I requested refund (total refund where I return item, or partial to cover damages) and seller replied "let me check with FedEx". I think they're dragging their feet.
This is a lot of money to me and I need this computer for my job. I need either the money or the computer ASAP.
What should I do with this situation?!?! thanks

Notify Ebay as well they will lean on the seller to refund the money.

I think you should get a hold of the seller, and file a lawsuit. It is his/her fault the s/he sold you a damaged computer. I think he wanted to get rid of it because it was damaged in a way. I think the reason why he said "Let me check with FedEx" is because he does not want to refund your money. You actually paid him/her for the computer AND the shipping. $1300 is a lot of money to purchase a used computer. You can also call your lawyer, and tell your lawyer what happened, and tell how much you spent. Also call FedEx, and ask them if they are responsible for damaged goods. My opinion is I would not buy a used computer, unless I know the person very well.

Did you pay via paypal.com?
If you did, you can file a claim with them. After you open the claim, you can send it back. You will have to state it is broken of course and enter into paypal the tracking number of your return to the seller. Paypal will acknowledge the seller has received it by tracking it themselves. Once they receive it, Paypal will issue you a refund. The Seller has no say on this. Its called a chargeback.

I sell on ebay and have been selling on there for a while. Try taking up your problem with all 3 sources. Complain to ebay, complain to FedEx, and talk to the seller. One out of the 3 will get something done about it.

I hope you paid for the item thru paypal.....if you did, file your complaint with them first. You only have 30 days to do this and also file the claim / complaint with Ebay. When the seller sees you mean business, he will either refund your money or panic.....or both.

something similar happened to my husband with an item that he purchased via ebay! Luckily my husband purchased it using our paypal account. If you contact ebay and paypal they will get your money back. It is not your responsibility to deal with fedex. The person you bought the item from should be bending over backward to take care of this situation! Good Luck and contact paypal and ebay with the issue!

3 months is a long time....
"It was improperly packaged (although I haven't told FedEx)." so this is the seller's fault...
I suggets you file a claim straight away....the later you leave it the claim period will end (it may already have ran out).
FedEx you can summit a complaint to the complaint dept OR a head, don't just speak to a worker.
