Stepson now of legal age to drive...who is responsible for his insurance?

My stepson lives with his mother and has now received his drivers license. She has decided not to pay for/obatain his insurance (but he is currently driving her car everyday.) She's wanting his father to pay for all. Who is liable and what is reasonable? My husband has agreed to pay for half. Her reason for not paying is that she is supplying the car. However, their oldest son was not allowed to drive until he had his own car-and at the time they were married and paying for his insurance. Please take into consideration she did not have custody of him for nine months, but yet still accepted the child support payments (totalling thousands). We live an hour away and have stepson every other weekend. She also agreed to pay for a gas allowance (but we found out that wasn' t the truth). The insurance will be to cover stepson in her car. I thought if an underage driver lives in your home, insurance cos. require you to maintain insurance on said person. There is no reasoning w/her.

Update:

I have no idea why stepson hasn't been made liable to pay for insurance. Original agreement between the parents was to divide payments among all three of them. That subject was dropped when stepson moved back with her..she has a habit of changing her mind to suit the day...

    You should check with your insurance company right away. Most policies exclude drivers under 25 unless they are specifically named. He is essentially driving without insurance. If he gets into an accident, they will come back on whoever's car he is driving.

    It doesn't seem that your husband will be held liable, since he's driving his mother's car. SHE will be the one toasted if the boy messes up. But, check with your insurance just to make sure. Sounds like both the mother and the kid are too immature to drive.

    I will tell you this. If he has a wreck whoever the car belongs to will be liable if it is not insured for him to drive. The court will not listen to excuses about who was supposed to pay or not. Just get him insured or don't let him drive. Here is an idea he can get a job and pay for his own insurance. Sounds like someone else is furnishing the car. If he is driving he needs to be responsible and at least pay for something, the car, the gas . or the insurance.

    i think this is something that has to be determined by each person involved.

    my son has to pay his own. if the stepson has an accident mom and dad both could be sued. so it would be cheaper if it got paid by someone so that everything that is important isn't taken away in law suits.

    what is wrong with stepson paying for it? it's never too early to start learning responsibilities.

    Yes, all underage drivers living in your home must be listed on your insurance....
