California ID, but a warrant in another state. Likelihood of being arrested?

I have a very close friend who has a warrant in Texas, it's a misdemeanor charge I believe. She has a couple of hot checks. She called about clearing it up, and found out she can send in a money order to get the check issue cleared up but the warrant still has to be taken care of. They told her that if she has 3 proofs of residency and an ID from the state she is in (California) that she can request the court to dismiss the warrant after she's paid the checks off. The issue she has is that she is paranoid to go into the DMV to get an ID due to the warrant she has in Texas. How likely is that she would be arrested if she were to go into the DMV in California to get an ID?

    The short answer here is that NO STATE can extradite on a misdemeanor warrant so even if California notices she has a warrant in Texas, and they won't know because it cannot be entereed in the interstate system, California still could not arrest her here. Take care of it.

    Nahh,There are too many people running around in Cal with warrants for the way too busy DMV to run NCICs on everybody who comes in. Contrary to some peoples belief, the DMV does not have cops hiding in the back rooms to arrest people. Go get your Cal ID and quit sweating. Fact. And by the way, there are states that do extradite on misdomenors,contrary to what that other person just wrote. Sorry guy,been there and seen that.

    I'd say, soon as the money order has been in the mail for a business week, go down to CA DMV and retake the driver's license test and/or just get a photo ID that state agencies do. Don't ask for a transfer unless you're turning in a CA out-of-date license. There is no national database yet, but it's coming. The feds are pounding on the EU to request forfeiture of any American license to get an EU driver's license, which sucks becuz an EU license costs $600 to $1,400+ (but it's good for life).

    the dmv deals with dmv issues. if she goes to the dmv, they simply will check her driving record and any driving offenses. the bad check problem she has will not show up. the dmv does not check for warrants. now, if she is stopped for any reasson and the police check her on their computer she will show a warrant out for her and will be arrested. she should take care of the stuff in texas, obtain paperwork proof of its closure and then be done with it.

  • Not very likely, but I am not in CA. I know that most states do not do a background check for ID's. But, with the Patriot Act constricting a lot of logical and common sense procedures, who the hell knows. She should contact a lawyer in both CA and TX.
