On probation for Poss. of mar. Failed Piss test.?
Just a quick question. If you really don't know please don't answer. I fail a drug test on probation, I just need to know if they can take me into custody with out a warrant. I was under the impression that a warrant will be issued by the judge when he sees you messed up. If there is no warrant can they take me???
I know i messed you and i don't need a bunch of people talking trash, Simple question needs simple answer.

Well technically there is no warrant actually needed to secure your arrest if it is on a verbal order from the Judge while you are in court. However your PO will more than likely ask the judge to issue one for a Probation Violation prior to that date.

Your probation officer takes the test results to the judge. The judge whether or not to issue an arrest warrant. You don't have to be notified that a warrant has been issued. You can be charged with violating your probation and receive a new sentence.

In my state, a probationer can be arrested by his PO, or any law enforcement officer who has a reasonable suspicion that the probationer is in violation. They don't need a warrant. The person can be held for up to 72 hours, and must appear before a judge during that time to determine if he/she can continue to be held.

no the police cant lock you up w/o a warrant. your P.O. has to let the judge know you failed your piss test and it is at his discrection to violate your probation. if it is your first dirty urine they almost never issue a warrant. your P.O. might want you to seek some treatment. but if your P.O. is an asshole she might want to violate you, but since your charge is most likely in district court they dont lock you up they usually just send you a summons for you to show up to court for your V.O.P.

Generally speaking your probation officer will arrest you for probabion violation if you are arrested that is. Go to your PO and talk to him/her dont wait until they come to get you. That looks better when you voluntarily turn your self in.

not for a probation violation but you can be arrested for use of a controlled substance
