I cant give two weeks notice- but I cant work either....?

I have been with my current employer 2 1/2 years. I am well paid but the office environment is toxic and negative. I have been offered another job elsewhere (still contingent on passing background and drug test). The right thing to do is give a two week notice, but I need this time to arrange a change in childcare before the new job starts- here are some known facts:

1)My employment there is on the rocks- they said time off that I took for sick days werent FMLA. I already contacted the labor board and they said that those days were covered. I hated going the tattletale route, but I didnt have a choice

2)I am considered an "extra". Work has slowed down enough that there isnt enough for me to do and they would rather write me out of a job than pay unemployment. If I give two weeks notice they may just ask me to go.

In the end- I have a potential job waiting for me. I need at least a week to secure my childcare. The right thing to do is give notice, but I cant work these 2 weeks.

    Without knowing a lot more about it, it is hard to give you solid advice. Here it goes: If the type of work you are doing is immoral or dishonest then you can feel free to walk away without guilt. If it is honest work and you just don't like it, then you had better keep working there until you find a better job to set into. If you find a better job first, then nobody can fault you for leaving this one including the people you currently work for and your parents. If you decide to quit without finding a new job first then you absolutely should give them at least 2 weeks notice. There will always be some parts of any job that you really don't like.

    Two weeks notice is the polite thing to do, but sometimes it just isn't possible. Once you have the job, go ahead and give notice, but if things are as bad as you say, they will probably tell you to leave. Most companies don't want someone around who isn't leaving on good terms. If they don't ask you to leave, start calling in sick. If you are in a work at will state, notice is a courtesy, not mandatory, so you could just leave.

    Regarding the FMLA, keep in mind that you have most likely gotten the opinion of a clerk in the office based on what you told them. They would not be able to make a correct determination until they have heard both sides in a hearing.

    Not having enough work for you is grounds for unemployment if your hours are reduced or you are terminated or laid off.

    You want to secure the job before you quit, otherwise you can't pay for child care. If youre an extra, ask to cut back on hours, say you've got personal issues. But if I were you I'd keep the main job until I knew for sure that I had the new one in the bag.

    yes. the right thing to do is to put in a 2 week notice. but also let them know that you can't work. It safer to put in a notice so you can have a good reference in the future.
