Is a deferred conviction on your record?

I do both some prosecution and some defense work and I know the answer for sure. After the deferral period expires, the COURT record disappears. The arrest record stays for about 3 years and then drops off. You can honestly say he was charged, but the charges were dropped if he got a deferral. Caution--the Court isn't always as quick as they could be in updating their records. See if you can find your case on washingtonstatecourts.com. That's an odd site compared to my state's site. You should find a link to case look-up, which I did by typing "case look up" in the lower right corner. Then it led me to the names of the various courts in Washington state and I didn't know what court to look under.

Deferred Misdemeanor

You can't be convicted without being charged. And, yes, apartment buildings will look at misdemeanor records when doing background checks. If it's a class A he may have trouble. Class C, unlikely. Class B, depends on what the charge was.

A deferred means that he was convicted but never charged for the crime. Most places will only look at a felony record deferred or not.
