Is it legal for others to use my picture online without my permission?

I think someone else at school has taken my picture with a camera phone and posted it on MySpace without my knowledge or consent. I'm not positive about it yet, but if he has done this-especially since I'm sure he's using it to make fun of me-what can I do? Can I do anything?

Update:

I failed to mention: We go to school "together" (I use quotation marks 'cuz I don't like 'im) and if he did take my picture, it would be during second period. He sits very near me, and the classroom is configured such that he'd have no problem taking my picture. It's no "candid camera" situation.

    If he took the picture in a public place, then there is nothing you can do. You don't have an expectation of privacy. However, if he is using it to malign you, then you may have a cause of action; there are limits on what may be done if you are not a politician, celebrity or other 'public figure'.

    Simply posting a snapshot of someone you see in a park or a mall would not be actionable.

    I think it depends what kind of picture it is. If it's a closeup, then it's at very least unethical and it might be illegal depending on where you're at. But if it's a public or semi-public place and you're just in it somewhere, I think there's nothing you can do about it. Pictures of a school, shopping mall or street anywhere in your town will always have people in it and you don't have to ask their permission to publish or sell that picture.

    Probably but you can complain. People do this all the time and most don't get in trouble except a strongly worded letter from whatever server they are on.. unless the picture is copyrighted they can do just about anything on the internet.

    yes and no....if in school and for school things then yes if your parents gave consent for you to be photographed... if the picture in any way harms you to the point that you feel that your life or reputation has been harmed then can sue... otherwise they can take your pic... if it was at school might let the principal know that this picture was taken without consent of the school and posted so they might do something... hope it helps...

    pictures taken in public or meetings or for art are constitutionally protected otherwise.

    if its on myspace, goto the help thing and email them and they'll remove it, if it goes up again tell them again and they'll suspend the account. you could goto lawyers n stuf but that shits expensive. just take pics back and put them up on the net lots

    i think it's illegal

    I'm pretty sure you can on Myspace and report it
