When you got divorced, you should have refinanced the house under your name only. Your ex is still part owner of the house if his name is still on the deed. Is it listed anywhere in your divorce papers that your ex will not get any money if you sell the house? Were you ordered by the courts to refinance the house? You may want to contact a lawyer about this.

Who is on the DEED? It should be just you...start there. Once you are the sole listed owner, then work with the mortgage company to remove his name.
I'm not sure you CAN sell unless his name is removed.
