How do I get my deported girlfriend back ?

My girlfriend of six months has been sent back to her country but i dearly want her back. She has been allowed to stay, live and work here for 11 years but now the home office have decided that she has overstayed and have removed her

    Frisky's answer is correct. You need to find out if she was deported, following an order by a court for example, or just removed as an overstayer. If it was simple removal (most likely), there is a chance: you will need to take the plunge and get married. She could apply to return as your fiancee, or you could go over there and marry and then she can apply to come as your wife. Both applications require you to show that you can support and accommodate her without her needing to work. In the circumstances, expect the application to be looked at very carefully. I would recommend that you find an immigration solicitor who can guide you through the process; you don't want any slip-ups now. It's quite likely that your application would be refused, but you can appeal.

    You need to be pretty sure that this is what you really want. I would recommend visiting her in her country, getting to know her, her family, and her background better. This would also make your case a bit more credible with the Home Office.

    Deported implies that the US deported her not her own country. If she was deported, was it because she overstayed her VISA requirements?

    You indicated that she worked and lived here for 11 years. That indicates she didn't pay taxes on wages earned, because she was illegal stay. So technically she had all our rights while not paying taxes for any of it.

    If you lover her that much you can go join her in her country and get married. Then re-apply for residence, if she wants to come back in.

    Even with that I thinks she has to wait at least a two period before re-submitting. Ask a lawyer versed in immigration & naturalization.

    I take it you are in the UK.

    Do you mean DEPORTED or REMOVED? You use both. If she has been removed she can seek to re-enter but as a long term overstayer would be well advised to seek entry clearance (which...let's face it...she probably won't get unless the can qualify for one of the higher category ECs eg Fiancee or Spouse). If she was DEPORTED then she can NEVER lawfully return to the UK unless the deportation order is overturned or recinded.

    As everyone else is telling you, if you love her - if - go to her country to live. Ha, don`t love her that much huh, I thought not!

    unfortunally when you brake the immigration law , there is a penalty with it , if found out .......

    she will have to wait and perhaps re-apply in some years later

    you can always try an immigration attorney , but it will cost you alot of money , and the results are not sure ?

    why don't you join her, in her country, ? its good to know that the immigration dept is doing something, i though they were just passing bits of paper between each other. Still marry her and she will be able to come back.

    As an over stayer, your g/f has broken the law, so I don't think she will be allowed back, sorry dude but rules are rules and she broke them, and the home office are well justified in sending her and any other over stayer back, she was lucky, my mate over stayed in Australia, they stuck him in jail, the law is the law! disobey at your peril.

    Honestly mate,what you can do is go to her home country,marry her and she can then get a visa to come back here with ya,that is if you love her that much and you think its her you want to spend the rest of your life with,or better still consult a solicitor for the legal angle,good luck
