Abortion question.?

In most states, if you deliberately kill a pregnant woman and her unborn child, you can be charged with murdering the unborn child. The law considers the unborn child to be a person.

However, if you are a doctor and you deliberately kill an unborn child by performing an abortion, you cannot be charged with murder.

Explain that one.

    My guess would be that the state laws regarding making a the murder a double homicide have some recognition of how far along the woman was in her pregnancy. Abortions are also illegal if the woman is beyond a certain point in her pregnancy. I have never heard of a woman being granted an abortion when she was in labor for instance. The debate has always been on the point that something stops being a clump of dividing cells and starts to be a child. Is a morning after pill the same as an abortion? Is it a murder. Many people say yes it is. Many people say the second conception takes place the object is a child with every right of a child. Others say thats ridiculous.

    The child is only considered to be a human being after the 8-12 weeks of pregnancy. I'm guessing when a woman and her unborn child is murdered, the unborn child is older than the 8-12 weeks. So therefore it would be considered a double murder. I am definitly not for abortion, so don't think that i'm trying to stick up for the doctors that do this cause I'm not. But usually women who are pregnant when they are murdered are usuallly more than 8-12 weeks along in their pregnancy.

    Personally I think abortion is wrong. Its murder. There is no way of getting around it, it just is.

    Maybe the difference in someone killing a pregnant woman and her unborn child and a doctor doing it. Is the fact that a doctor has a licence to practice it. And the fact that a woman chooses to kill her baby. Instead of it being done against her will by someone other than a doctor coming after her.

    Either way you put it... its still murder.

    The only reason abortion (in my opinion) should be performed is if it puts the mother in a life or death situation.

    Its pretty easy to explain, actually, and it has nothing to do with hypocrisy. In most cases, the fetal homicide laws are seen as fairly transparent attempts to lay the groundwork to take away the right to choose an abortion. These are recent laws, from the era when anti-choice forces have developed new tactics to get their way.

    If you want to examine hypocrisy, tell me why none of the jurisdictions that recognize a fetus as a person for purposes of murder allow people to drive or vote at 17 years, 3 months, or drink at 20 years, 3 months. They're not really calling fetuses people, they're just trying to take away a woman's choice.

    I dont really understand anyone choosing to abort their child. I feel like if God chose to bless you with that child.. wether you want it or not he already made that decision for you. I dont have kids yet, but dont see how anyone could make the decision to not even give a baby chance. You know they have a life planned for it them. If you dont want them put them up for adoption, So many other people cant have children. And would love to have the opportunity to have a baby.

    I dont think its ever right even for the doctor to kill an unborn child.

    There is no way to explain it if you are pro-life. The circumstances are only different in that the first is a criminal offence due to someone else with their recklessness murdering someone and their unborn child. The second to pro choice advocates is only a medical procedure like having your tonsils removed just wasted tissue in your body. That is why there is nor burial or death certificate required in the second case either.

    Some doctors will only perform an abortion if there is something seriously wrong with the baby or if the mother's health is in serious trouble. But then again, most doctors will give other options to abortion like adoption, etc.

    the thing is u have written consent from the woman about the abortion and its all in the way u look at it like say a woman thats pregnant does something that causes a miscarriage wud u press murder charges on her for that.

    I'm sure it has something to do with pro-choice. That mother is the carrier of the child, and feels it is her right to chose whether she wants to have the child or not. She consents with the doctor to have the abortion.

    But I'm sure she didn't consent to having someone come and kill her and the child! How odd would that be. That person took her life and the child, and I guess it is taken into consideration that the mother wanted the child to be born. Can't really ask her, she's dead now.

    It is kind of messed up though.

    Making the murdering of a pregnant woman into two crimes is a fairly recent phenomenon. The rest of the laws have not caught up with that yet.
