Is this possible?
I live in Florida and I have custody of my daughter. My ex has nothing to do with her and isn't even on her birth certificate and hasn't shown up for the paternity test. There is no doubt though that he is her father and him and I were talking about him signing over his rights to our daughter in order for my boyfriend to adopt her. My questions are... Is it possible for my boyfriend to adopt her even if we're not married yet and if not can my ex still give up his rights and not pay child support?

the courts might let your bf adopt, but they are going to STRONGLY suggest you marry first. Once you're married, it will be no problem though...as long as the father really does sign away his rights.
He cannot get out of child support unless you let him, no. He can request a paternity test to prove he's not the father and if he's not he can get out of support that way. You can allow him to sign off his rights and get out of child support if you want, but the courts won't let him shirk his responsibilities if you aren't able or willing to take them one in addition to your own... no matter how little he cares for his child.

Your daughter technically doesn't have a father. There is no father named on the birth certificate and since the father has not claimed any parental rights to your child, then as far as the court is concerned, you are the only parent. Now, if your ex wants to fight for custody, and since there is no father's name on the birth certificate, he would first have to prove paternity and then show that he wants to be a part of this little girls life. If your boyfriend wants to adopt the child as his daughter, all you have to do is allow him to.

Dont go through the adoption process, if your ex hasnt signed the BC he has no rights. Period. The easiest thing to do is take the origional copy of your daughters BC and her latest shot records, go to the SS Office, and have her name changed. It really is that simple, your boyfriend will be allowed to sign the BC there in the SS office.
But I would suggest getting married before you go through all of that! Make sure you are doing the right thing!
