Why is a woman who has sex with a minor treated differently than a man who has sex with a minor?

    Cause a male has to get an errection and penetrate the female. By most accounts the arrousal and penitration imply active participation and consent. Additionally, an adolecent male is still stronger than most adult females. People just can't picture a man being forced to have sex. The preconception that rape, even statutory rape, is an act of violation and force causes an conflict in consideration of a female raping a male.

    Throw in that males are generally willing to hump any girl who stands still long enough and no one can picture the underage male as having been forced or really even coerced.

    So you keep getting these comments of "I wish I had a teacher like that" and poof, society doesn't care as much.

    I think it is partially due to:

    a) the stigma of females having sex young or outside of marriage, so when a "little" girl is "duped" into sex, they hold the older male more accountable. (In other words, it's ok for a boy to be experienced when young, but girls are supposed to be less capable of making their own decisions and should be pure.)

    b) there is still the possibility of the girl getting pregnant. Not a possibility with the boy. There is a tremendous amount of stigma associated with that, as well.

    c) men tend to be more sexually agressive. And girls often put more emotional investment into a sexual relationship. So it's assumed that the girl will have trauma, but the boy will not be as affected by this.

    In any case, I'm assuming you didn't mean rape. That would be far worse than a young person making poor decisions, and an adult being completely unresponsible.

    It should be equal justice for both sexes. In the news, there have been female teachers that have been prosecuted for having sex with their students, so where are you coming from? Now a days, it is just as offensive to have sex, whether you are an adult male or female, with a minor, and can be prosecuted with the same penalty, male or female, doesn't matter.

    You have asked a good question but as it's lean on detail it can only mean that.

    The woman is not violating by penetration and it is deemed a man may.

    Note penetration became an issue some years ago in New Zealand in defining sexual violation.
