Should this be showing on a driving record?

My son was cited for possession of marijuana when he was 15 years old and probation suspended his ability to get his licence for 1 year. he is now 18 and a recent DMV printout showed this on his driving record. He didn't get a licence until he was 18. Shouldnt this possession charge not show because he was a minor and how do we get it removed? It had nothing to do with operating a vehicle.

    I think you can go to court and have his record sealed because he is now 18. I don't know why it would show up on his driving record if he had no license at the time but call the clerks office and find out how to have his juvenile records sealed.

    In Pa. there is a law that anything used in juvenile court cannot be used against the juvenile elsewhere. It has been modified since I utilized it to get my license @ 18, as they wanted to keep it until I turned 25. As to juvenile records availability after 18, there's an avenue to approach the issue from. But, in today's "get tough" world, he may have found a loophole in the juvenile record issue that he cannot fix, one on the side of enforcement abuses. The abuses are not uncommon these days, I have family who does stupid stuff still, so I keep seeing them when these abuses occur to my kin. GOOD LUCK!!

    BTW flame on, burning bright, how many rights are we to cede to the man's "protection" of ourselves from ourselves? You sound very like enforcement officers already, thought about a career in police work? JUVENILE stuff should NOT carry over through your entire life, making you a continuous target for life over a minor childhood indiscretion, no matter what a few flaming A@#holes, who burn bright in the night,(lol) have to say on the issue. I know where the name originated, as flaming a*&^les do , indeed, appear to be "Burning bright" to the casual observer. Let's not forget the freedoms our forefathers gave us that the current leaders have stolen already, and resist them stealing yet more. K?

    Sorry "vast guy", yet each and all the states join a countrywide registry of motorcar violations. whilst your California license desires to be renewed, the state RMV, will run your call and social in the process the pcs, and your fee ticket will pop up. this would bar you from getting authorized till that's paid, and entered into the computer as paid. in case you get stopped for a motorcar violation, and you get "run" it could pop up back. What the cop does then, possibly relies upon on your preliminary attitude. Be impressive and stay out of penal complex.

    in certain states on a drug conviction your license is revoked, and on the license return (when a police runs the driver's license) it says, "drug charge mandatory suspension". he did not have a driver's license at the time but it will still say the same thing. no, you cannot get this removed. you can get a juveniles criminal history expunged but police have access to more information than the general public and this will always be on the turds driver's license return. instead of focusing your energy on "how to get this off his record" focus it on encouraging your son to not smoke marijuana.

  • i know that usually most crimes on a criminal record do change when you turn 18. however i don't think it is the same as your driving record. i think that stays on there.

    It is a good indication for the police to search his car when he is pulled over and if he is clean he has nothing to worry about now has he.~~

    good luck i had a bike ticket stay on mine for 7 years ,you can fight the man ,but you cant win .
