Was George W. wrong?

I see a lot of similar comments about George Bush demonstrating contempt for the constitution, but In 1796, Washington refused the House of Representatives demand for papers related to the Jay Treaty with Great Britain, saying that " The Constitution barred the House from the making of treaties. Firing U.S. attorneys and any other executive officers, including those requiring Senate approval, rests beyond the constitutional powers of Congress, and totally within those of the presidency." This has been true since the first cabinet departments were established in 1789.The Supreme Court held in 1959 that, "Since Congress may only investigate into those areas in which it may potentially legislate or appropriate, it cannot inquire into matters which are within the exclusive province of one or the other branches of the Government." If the Democrats argument is right then George Washington is wrong about executive privilege.. Right??

The House was not asking for a copy of the treaty they were requesting correspondence between Washington and his people... which is what the democrats are doing.. His words were "it is essential to the due administration of the government, that the boundaries fixed by the constitution between the different departments should be preservedóa just regard to the constitution and to the duty of my office, under all the circumstances of this case, forbid a compliance with your request."

As for Clinton; he fighting sexual harassment claims by Paula Jones, an independent counsel corruption investigation into Whitewater, and his relationship with Monica Lewinsky. He asserted executive secrecy to protect his personal affairs. The federal courts of appeals have held that the privilege only applies to communications between the president and his advisers on "official government matters." Which is what the Democrats are demanding.

Nixon-In the 1974 Watergate tapes case, the Supreme Court said that the president's right to protect information is strongest when law enforcement, national security or his other constitutional powers are involved. Under that rule, Democrats have no right to see the president's communications about the firing of federal attorneys, the nomination of John Roberts or Samuel Alito to the Supreme Court or the reduction of Scooter Libby's sentence.

    See what would happen if George Bush wanted all the papers and e-mails from the Democrats in Congress pertaining to their budget planning for the military. Since the Pres has to sign or veto every spending bill, would that not be reasonable to see how they came up with their numbers?

    The Dems are pissing up a rope. They have no authority, and since you don't see them breaking down the doors of the Supreme Court, they know they don't. They are using this as an election year tactic with the help of the press. When this finally peters out, they will come up with something else.

    They would like everyone to believe that it is their Constitutional Duty to ride shotgun OVER the Executive Branch but it does not. The term "Checks and Balances" is the best little catch phrase they ever came up with and is their excuse for everything they do to block the Republicans. Personally, I wish the Democrats were as concerned about the taxes coming out of my "Checks" and the "Balances" of their social spending.

    You should be ashamed for mentioning George Bush Jr. in the same breath as George Washington. If George Washignton were alive today he would condemn the actions of Bush at nearly every stage of his presidency.

    By the way, George Washington is correct in his assertion that congress has no power to make treaties. However the assertion that executive privledge applies to any and all aspects of the executive branch has no basis in constitutional law. Ask any legal scholar (if you can find one) what exacty executive privledge entails, it is not a catch all for any document handled by the executive branch, it is very specific that it pertains strictly to private communications by the president himself.

    If executive privledge worked like Bush and his crony's are saying, Nixon would never have resigned, Clinton would never have been impeached. Bush and his ilk are trying to rewrite the rules to suit their own ends, sadly it is the misinformed (such as you) who believe him.

    Yes the congress probly doesn't have the leagal right to ask for his documents, but anyonr with more vision then a bat can see that something VERY suspicous is going on.

    Also if the bushy can trash the constitution and bill of rights at the same time for his own desires then congress can to, wtf, might as well have a free for all with all the abuse of our founding documents that has transpired over the last 100 years.

    We must admit that our system of government strives for "the more perfect union". It isn't a perfect union and mistakes have been made during our evolution; i.e. woman's suffrage, slavery, among other things. Likewise, we shouldn't accept Bush's act of defiance because Washington committed a similar act. Far too often I hear as justification for acts considered inappropriate ,"other presidents have done the same thing", i.e. the replacing of U.S Attorneys by Clinton. To this I say; First, two wrongs don't make a right, and two, if we want to continue to move toward that more perfect union that we desire, then moral fortitude must take precedence over political loyalty.

    I will say only this. If a US Attorney was fired because he was investigating the possible criminal activity of any member of the Executive Branch, including the President, the American public has the right to know. Justice and decency requires it. This is the USA, not Nazi Germany or Stalinist Russia. What happened to checks and balances?

    George Bush meets with the Queen of England. He asks her, "Your Majesty, how do you run such an efficient government? Are there any tips you can give to me?

    "Well," says the Queen, "the most important thing is to surround yourself with intelligent people."

    GW frowns. "But how do I know the people around me are really intelligent?"

    "Yes! Very good," says the Queen.

    Bush goes back home to ask Vice President Cheney the same question.

    "I'm not sure," says Cheney. "Let me get back to you on that one." Cheney goes to his advisors and asks every one, but none can give him an answer. Finally, he ends up in the men's room and recognizes Colin Powell's shoes in the next stall. Cheney shouts, "Colin! Can you answer this for me? Your mother and father have a child and it's not your brother or your sister. Who is it?"

    Colin Powell yells back, "That's easy. It's me!"

    Cheney smiles, and says, "Thanks!" Then, Cheney goes back to speak with Bush. "Say, I did some research and I have the answer to that riddle. It's Colin Powell."

    Bush gets up, stomps over to Cheney, and angrily yells into his face, "No, you idiot! It's Tony Blair!"
