Mississippi DUI Question?
What happens next? Someone I know got a felony DUI 6 years ago. And their license has been suspended since then. In July Me and my son was broke down on the side for the interstate so he came to help us. Well unfortunately he came across a road block. The police officer did not take him to jail he just gave him a ticket for driving with a suspended license (under implied consent). How long will it be before he can get his license back now? He could have gotten it back a year ago but he didn't know he could.
And when that time comes what steps does he need to take?

He needs to set up a court date.
Next he needs to go the the DMV and pay all the fees to get his license re-instated as he is eligible to do so.
When he goes into court, he needs to present to the judge that he was eligible for his license at the time of the stop and produce his now valid license to the court.
In most all cases the case will be a with-hold adjudication and he will get a small fine or court costs only.
No, this is not gospel.... it is entirely up to the judge... but in most all cases this will be what will happen.
