Tenenant or Landlord Responsibility?

My duplex has a spider problem. I'm usually finding 2-3 spiders a day in the house. Some days it is upwards to 5 or 6. If you walk around the house you can see spider egg's nest all over. I know the place wasn't lived in (except for the upstairs) for at least a year.

So who's responsibility is it to take care of the problem? My boyfriend thinks that we should take care of it ourselves. I feel it is the landlord's reponsiblity.

I moved in in the middle of April. We had a smaller problem back then, maybe one a day. It has stepped up recently possibly due to the fact the weather is cooling down. We have a lot of trees so I don't know if that is a factor.

Plus there is a garage maybe ten feet away. They haven't up kept the garage and the tenants don't have access to use it. They store a whole bunch of junk in there. There might be a possibility that the spiders are coming from there considering they never clean it out and tenanents aren't allowed to use it

    i think you will find it is up to you to sort it out, if your building was unsafe eg electrics damp cracks ect that would be up to your land lord to sort out

    You don't say how long you've been at the place. If it's only been a month or two, then I'd say it was the landlord's duty to get rid of them, since it would then have been an existing problem. If you've been there for much longer than that, then it kind of comes down to being yours to deal with, since it could be argued that you could have introduced the problem.

    Either way, you should mention the problem to the landlord. Even if you've been at the duplex for awhile he may simply wish to take care of it himself. Especially given that it is a duplex, and you trying to rid yourself of them might just drive them to the other one. He would be better equipped to get of them from the place completely.

    Additional: Given the additional details, I would place responsibility on your landlord. Even if you should manage to evict the little critters from your loft it will remain an ongoing problem, given the other circumstances. Therefore, the landlord needs to intervene in this matter.

    Review your lease. It will spell out who is supposed to handle that. In many leases the tenant, not the landlord, is responsible and if the issue gets to the point that other tenants are affected and the landlord steps in-you get billed for the service plus a hefty fee for not dealing with it in the first place. Never assume that your landlord is responsible for every since item-in many cases they will put as much of that back on you as is legally allowed.

    assuming you just moved in i would say the landlords. my family has 21 rent houses. when there is bug problems we take care of it. i would think it would be maintaining the upkeep of the house.

    however if you have been there a while and the problem just started (atleast a few months after moving in) then you should take care of the problem.

    Do what you can to get rid of the little buggers (no pun intended) but let the landlord know you have a critter problem and ask if there is something he can do about it. Be civil don't be rude, that won't help your situation.

    The landlord should take care of it.

    Send him a certified letter giving him 3 days to fix the problem or you're going to take care of it yourself & deduct the expense from your rent. Give him a copy of the receipt. Simple as that :)

    The landlord should take care of it. However, I would make sure you use some kind of spray in your place. eck! I hate spiders.
