W.Va Torture case?

The prosecutor wants to go for kidnapping, sexual assault and other such charges which will put the defendants in prison for life. He is not charging them with hate-crime. The Black churches are upset because there is not hate-crime being charged. Hate crime will send the defendants to prison for only 10 years. Am I missing something here or are the black church leaders that stupid not to ask for the longer sentence for the defendants? It is a hate-crime, no doubt about that but hey, why put them in prison for only 10 years when you can send them to the big house for life?

Update:

The hate crime concept is not ridiculous. If a person is attacked solely for the person's race, religion, political affiliation, sexual orientation, anything that is different from the attacker then it is a hate-crime. A crime based on hate.

    The hate crime is a separate charge, which if guilty would add an additional 10 years on any other charges they are found guilty of.

    Yes, I agree with you. Just because they don't want to say that it isn't a "hate crime" doesn't mean that it wont be brought up AS a hate crime.
