car insurance vey very urgent help needed.?
I had my insurance policy cancelled due to late payment ,i found this out only after i had a major car crash,i calledm y agent and he said just pay up now and you will be fine.so i made my payment right away and after a week after my accident information came up ,the insurance company is telling me due to delayed payment they will review and consider if they are willing to pay for my damages.
I did not get a letter or mail of any form saying my policy was cancelled in addition i have an active policy right now so its only a slight delay on payment. How do i negotiate with the insurance company if they are unwilling to pay?
This is a big crisis and i am ready to give more details if someone wants to know more before taking a shot at this.
Tomorrow i need to call back Allstate on this and find out if they have reviewd and accepted my request.
Ofcourse they can bend the rules is what my agent said. Me talking to higher officials would help??

If the policy was not in force on the date and time of the accident and you did not make the payment within the grace period - then there will not be coverage for it. You can reinstate the policy - but it will reinstate with a lapse. The reinstatement becomes effective when you made the payment - it does not go backward. If you made the payment during the grace period (if your company/state allows for one) then you may be ok.
I would be very shocked Allstate reinstates your policy back to the accident.
Insurance companies are highly regulated. We are monitored by the state. We can not bend the rules for you. The rules have to be equally enforced for everyone. If they make an exception for you- they would have to make that exception for every one of their policyholders. All of their policyholders would be allowed to let their policies lapse and only pay after a wreck to reinstate them. If your agent told you they can bend the rules - your agent is wrong.
Several weeks before your payment is due - you get a bill. On the bill is a due date. If you do not pay by the due date (or within the grace period that some companies offer) then your policy cancels. Most states do not require the insurance company to send you a letter saying "oops you missed it".
If you don't pay your water bill - you find out b/c you come home one day and the water is shut off. No warning...no hey - here's a chance to pay us - you just get no water if you don't pay your bill on time. Your insurance bill is just like any other. It's got to be paid by the date due.
If you have no coverage for the accident: the other person's insurance company will settle with them under their uninsured motorist coverage. The company will then contact you for repayment. You can set up an interest free payment plan with them. I am usually willing to take 100 per month until the debt is paid. As long as you make the payments they will not pursue legal action. You stop making those payments- they will suspend your drivers license and may sue you or turn you over to collections.

AD is right on the money;
Allstate may not make a decision right away since they have to investigate if your premium was w/in the guidelines of your policy; to deny a claim for coverage, they have to tip toe and verify they did everything required by law; that is the reason the insurance companies are regulated so that they dont "just deny" to make more money;
in any company i have worked for, denial of coverage usually took couple of weeks to a month to verify that our coverage would stand if ever sued; you can talk to all the other higher officials in the company, but it wont affect the outcome;
if''''''they deny this claim, then i might consider seeking legal advice to confirm you have no recourse;
also; if they deny and the other company goes after you, try and work out an agreement for repayment like AD said; most companies are willing to try and negotiate with you;

Allstate has the option of taking your premium or NOT. You have the responsibility of keeping up with your insurance -- not Allstate. If they have agreed to review your case then it's a good chance they will accept payment and cover your for this loss. Keep in mind that they DO NOT have any obligation to do so...your policy ended when you didn't pay the bill. If you dodge this bullet then I suggest you get direct bank transfer to Allstate in the future.

Personally, I have them take deductions directly from my account every month. Car insurance is one thing I won't forget to pay. It's too important, because you never know what's going to happen. You're not in control of others on the road, over half of which aren't insured.
I hope this all works out for you. I've never been late on that payment (but have been on plenty of other things) so I'm not sure what they'll do. Best Wishes!

If you had a lapse in coverage, and you had an accident, and you paid after, and they reinstated you policy WITH a lapse, changing your effective date, you are out of luck.
if you reinstated it and you kept your effective date, you might luck out...
you cant negotiate with them on this. If you coverage didn't exist, that's a problem for you. Auto insurance isn't something you want to forget to pay, as you can see now.

You are approaching this wrong. You are thinking of insurance companies as being in business to "Help YOU!" Nothing could be farther from the truth. Insurance companies are in business to make their shareholders rich. As soon as you can come to grips with that fact you will be on the right track.
Whatever their decision is (and I wager almost anything I have that it will not be in your favor) you have to do whatever you can to make this situation right.
Were you at fault in the car crash? Was the other person at fault in the car crash?

Contact your State Department of Insurance and explain to then what is going on and ask what recourse you have.
If you have a gripe about what is happening to you, you can tell them while on the phone.
