FMLA or medical leave of absence help!?
My daughter has had a real tough year medically. She started out the year with spraining her ankle, then became pregnant and had a miscarraige and now is experiencing extreme headaches. She has used her 12 weeks FMLA for when she sprained her ankle in the beginning of this year, is she eligible to reapply? They are threatening to fire her and she has doctor's notes. Is that legal? Do you know what we need to do?

She may need to take a medical leave. But she also needs to know where she stands. She should obtain, in writing, a copy of company policy from HR (Human Resources) concerning medical leaves and leaves of absence. This is something she have been given when she was hired but has long misplaced, like most of us. technically, she can't be terminated for being sick but she can be replaced or transferred if her absence requires it. As for reapplying for FMLA, she needs to know the policy. She may not be eligible for another 12 weeks within a 24-month period.
