Employment Age Descrimination?

My girl-friend was recently denied a full time position at her current job as a cashier. The employer stated that they did not want to hire her full time because of her age (she is 22) and because she is not mature enough.

Are they in violation of any law or regulation?

    Yes, that is against the law. An employer can not deny her a job due to his perception of "maturity" based on her age. If she performs the job as well as the other employers, he did wrong. However, If she is employed at a company where her coworkers are older and more experienced, that could be where the boss is coming from. So take in all the details and work things out. best advice....have your gf talk to her boss and see where he was coming from and how to correct the situation.

    If they STATED AGE as a condition of employment, then YES they are in violation of the Age Descrimination laws.... however, if they only mentioned her "immaturity", then they are NOT in violation.... problem here would be it would be HER word against her employers... unless there was a witness that heard the employer say she was not hired full time because of her age.... Now, they COULD have said that to not hurt her feelings as well.... lets say for argument sake that she isn't a very reliable or good worker in the part time position but they did NOT want to TELL her that...... maybe they want to give her more time to MATURE and become better in the part time position before they consider her for a full time position. although THAT is what they should have told her, maybe they decided to say she was too young to spare having to tell her she wasn't good enough.... I think it might be a difficult case to prove, but if they said AGE was a factor, they were wrong. age CANNOT be a factor....

    Unless you were at the job interview, I would wager that your girlfriend lied to you.

    At 22, if she was told that she was not mature enough for a job as a cashier (a job that they hire high-school students for every day), then she must have really blown the interview or made a fool out of herself.

    At 22, it is not in a protected age class...that starts at 45.

    However, I think she lied to you.

    This bewilders me. maximum of those companys want the suitable worker, ones that don't use drugs and such. per danger the difficulty became which you have been too appropriate for it to be genuine?? I in no way understood temp companies or those that decide to artwork for them. They rather get an element of your paycheck. They pay you below what you will desire to artwork for the employer promptly. appears like a crock. Are those human beings an EOE?? Do they promote that they are EOE?? if so, they might desire to offer you motives for no longer hiring you. Shoveling snow is extraordinarily trouble-free while you're in shape to realize this. good success and don't enable this burn you up too undesirable.

    Unless Georgia has a seperate law, Federal age discrimination laws only protect people over the age of 40.

    If they don't think she is mature, she is better off asking how she can improve her performance rather than trying to sue.

    Age discrimination doesn't come into play until the employee reaches 40. You can't discriminate against older employees because company often want to fire them because they make more money than those younger folks just joining a company.

    I think the denial was perfectly legal.

  • Age is not supposed to be and issue, if you can prove they did this you have a case. The immaturity part maybe the issue at hand, get your facts straight before you proceed on any course of action.
