In NYS is it illegal for can a father to record his daughter while on the phone?
There has been some concern over a boy my daughter is seeing as well as other bad choices she is making in her life. Is it illegal to tape phone conversations when concerned with her safety? Thanks for any advice you can give

I am not an officer of the law, but in concerns of a childs well being most judges will proubly back the parents. This is even stronger if they are a minor and live in the same household. As a parent myself I would do anything to keep the safety of my kids and family. Just remember that eventually they will have to leave home and if the relations with questionable boys is still an issue it will just lead to more resentment. You will have to pull the feeding hand away or they will tend to continually look for you to bail them out from their poor choices. Sometimes you have to let them fall and learn from their choices. I say its your house, and proubly your phone bill so what is to stop you from recording what happens on your phone.

As far as the legality is concerned, one person in the conversation being recorded has to be aware of the recording. I'm am not entirely sure if this still applied when it comes to minors, but it would be a breech of privacy and would likely cause a further riff in your relaionship. Take other more active measures to keep track of your daughter

It is generally illegal to record such a conversation in New York. N.Y. Penal Law §§ 250.00, 250.05: It is a Class E felony to overhear or record a telephonic or telegraphic communication if one is not the sender or receiver, or does not have the consent of either the sender or receiver. It also is a crime for someone not present to overhear or record any conversation or discussion without the consent of at least one party to that conversation.
However, if I were in your shoes, I would privately do it anyway if it is going to keep my daughter alive and out of trouble.

I wouldn't suggest it because if your daughter finds out then she will likely rebel even more than she would have otherwise. I'd rather try to find a way to get through to her that does not risk ruining your relationship with her permanantly and push her off the edge she is on.
