Auto accident situation....?
My husband backed into a little old lady in a private parking lot. His bumper slightly dented her front door. She was asked to get 2 estimates for damages because her auto was an 18 yr old sedan in not great condition. Five days later we were called and the estimates were both over $1,000. The auto according to Kbb, in good shape, is worth way less than that figure. We offered to repair not purchase the auto! They will not work with us and we found good replacement doors, in the exact color, for between $100. - $300. We are being threathened with lawsuit. What do we do?
The ladies son is the problem. I tried to explain auto values versus extortion value. The ladies car is maybe, from all I've found, worth at "best" $700. Son is a screamer! I called local law enforcement and was advised not to pay... Go to court. Son got mouthy with policeman. Go figure!

If the estimates to repair are more than the value of the car there is 1 and only 1 outcome. The insurance company MUST total her vehicle, pay her the "value" of the vehicle" and move on. This is not something that can be disputed, there is no negotiation involved...it's fairly simple. There will be no lawsuit at this point, it was apparently not filed with an insurance company?
She also has apparently not communicated this accident to her insurance company....this basically makes any lawsuit threat null and void. If it was not reported to her insurance (in particular) she cannot sue you in a civil court for damage.
Obviously the collision shops she received quotes from are in need of business (or the little old lady is trying to scam you), also keep in mind when a collission shop works with an insurance company they quote all new parts, and factory quality paint. They may not use these items but that's how it's quoted. If that's the case I can see the bill inching towards $1,000 easy.
In short ignore her threat to sue, if neither of you have reported it she can take your offer to have it repaired or she can take her claim to her insurance company and you do the same. At this point in the situation there are no other "legal" options available.
Hope this helps.
