Purchased Used Car From Dealer-Missing Title?
My husband and I were looking for a decent economical 4 cylinder pickup to run around in and we found one from our local used car dealer. We used a privately obtained loan as this was a cash dealer, he does not do financing. It has been 5 weeks, he has had to reissue a sales contract so we could get our second set of temp tags. If we are unable to get a title by the middle of next month, are we justified in asking for a refund of our purchase price as well as any interest we have paid? Is this a common occurence? This dealer has been in business for over 40 years and this is a small town. He bought the truck from a dealers auction in another town and state. Thanks for any assistance!

If he does not file missing title application, go to DMV to get temporary title, then call the police and have car checked to see if it was stolen. If not then CONSULT a lawyer due to the fact if dealer lost title he probably sent for new one and it then has to be put in your name. This should have been done the day you bought car. Never pay cash for a car without getting title.

Every state is different when it comes to title issues. In Illinois, it is not uncommon to buy a vehicle at an auction and not have a title. In my state, I have 30 days to deliver a title to the auction the vehicle was purchased from. Here is the reasoning...
If a buyer trades in a car that he/she has lost the title to it's easy to receive a replacement from the state. It just takes time. In the meantime, the dealer has money wrapped up in a car that has a new title on the way. Rather than letting his money sit there on the lot, he can sell the car at auction as long as he shows a copy of the lost title application.
If the dealer you purchased from has been in business 40 years, he obviously knows what he's doing. Rather than throwing your arms up and crying fowl on a Yahoo Answers board, why not pick up the phone and ASK HIM??? That's the most direct approach. I would bet the state is backed up which is causing the delay. Or it could even be as simple as waiting on the previous owner to sign the replacement title.

In Pa. you can not sell a truck without a title. This truck will never be yours until you have the title in your name. You need to go to him and be firm that you either get the title or your money, he gets the truck back. Be careful you don't damage it or hurt someone in the meantime this deal is full of pitfalls.

He will have to refund your money, obviously, if he can't convey a title. He doesn't want to go to jail any more than you do.
I don't think it's a common occurence, he just was dealing with some low-life when he bought the truck.

Find the Vehicle Identification number ( VIN ) And call the police and explain your situation.
