ebay fraud? help?
in victoria, if someone has been charged with 50 counts of ebay fraud rounding up to approximately 20,000, what is the most likely sentence for this, is it possible that an ico would e handed down here and any one had any experience relating to fraud and sentencing act

Quite often - if people don't have a previous criminal record (or if they have a minimal one) - criminals in these types of offenses are put on probation. The reason for this is to try to get them to pay restitution.
Locally, I've seen criminals put on probation for thefts of over $100,000. These guys generally have high monthly payments, due to the restitution. And, many have a tough time making the payments. In the end - some end up paying it all off, and some do not. If they don't - then they can have their probation revoked and be sent to prison.
However, the courts generally try their best not to do that - because the victims will never get their money back then.
But - if this guy has a criminal history of these types of crimes, and not paying the restitution, they may just go ahead and send him to prison right away.

I've been a member of eBay for almost ten years now. I have lost about $100 in various transactions. There are crooks that sign on and you can't always get your money back. Their security page lists resources that people can follow. The only guarantees are when you use a credit card to pay.
As far as punishment, I hope they throw the book at ALL scammers. No mercy. The most painful lose to me was when i bought some Yugioh! cards for my little son, for Christmas. He was 8 or so. After he started opening packs, he realized they were counterfeits. I reported the crime to Upper Deck, the father of the seller even begged me to withdraw all charges.
In spite of it all, nothing replaced my loss and the sadness of my little son's heart. I have no mercy on scammers.
