to sue or not to sue, that is the question?

My son was bitten by a dog while visiting a friends house around the block from where we live. The 2 kids were outside playing hide and seek when the dog came out of a neighbors backyard and charged the kids who were playing on the sidewalk at the end of the driveway belonging to house where the dog lived. My wife and I are not litigous people, we are very hard working and have always earned what we have. We have decent jobs, but like 90% of the US population, we live paycheck to paycheck. If we decided to sue the money would go into our sons college fund or into a family vacation. I do not feel that I am owed anything other than the expenses that I am out due to the incident, i.e. medical expenses, loss of work, etc. But is my son due compensation for the trauma. He has been having nightmares since the incident and has missed days of school. What would you do?

    I would go for loss wages, medical and proably some thing little for your son like for trauma but at the same time I would see about the dogs history and if this was not the first time it bit I would also see about getting him put to sleep but that would only be if this was the second or thrid time it bit. If it was the first I would make sure to report it but not propose putting it down. Then everything you get either pay off back bills or put in college education for your son.

    Think about the effect it will have on the family you are suing. The money would be good for your son's future, but you might be depriving their kids of a college education if you do sue.

    I would definitely sue. The owners need to understand that a dog can't be let loose on the street. Anyway, if they have homeowners insurance, it'll cover it.
