Two questions: Is this legal? Will my friend get in trouble?

In past years, a friend of mine has donated large sums to pay for baseball/softball uniforms and equipment for a local league. He thought it was a non profit and they gave him a tax id number. Turns out they do NOT have non profit status and the tax id number is for the town parks and recreation department. The league is NOT part of the town gov't---they've just been using the number.

We found this out when his brother J got his employer (a large chain store) to agree to donate $$$$ to fix the fields. He asked the league for a tax id and they gave him the number but told him it really belonged to parks and rec because they aren't a registered non-profit or even legally an organization. J's boss said that using that tax id was illegal and he wouldn't donate.

Is this illegal? (There's also a bank account with the tax id on it)

Could my friend get in trouble for deducting past donations?

Should he do/say anything about this?

Update:

PS The league is run by a group of 4 people and there is no public accounting for how much money is raised and where it goes.

    Tax laws are very strict. I am not an expert, but I would say that anything they can do to limit the amount of deductions will be done. We had a similar situation here with a bingo parlor and those boys were sent to prison, which is probably what may happen with the four that are running the league. As for your friend, he should seek legal counsel before using this tax ID number to claim the deductions. I doubt he would get in too much trouble for it, but an in-depth audit is almost a guarantee.

    That's a very good question. If the money was donated to help the fields, then you can use the tax id, since the fields belong to the Dept, not the group, however I don't think the money should be donated to the group, it should be donated to the Dept only. I would call the Dept of park and recreation and see what they say about the group/league. if they authorize the league to use their id #, then your friend should be fine.
