forced vacation?

I work for a company that is in a slow period right now. They have mandated that one day a week we are to use PTO (paid time off) vacation time so that they can use the money they allot for that to stay on top during the lean season. The problem is I work as the only point of contact for the region I live in and am never really off the clock. In fact I have to be able to return a call within one hour and be at a customers site within 4 hours.

I live in minnesota and my parent company is out of PA. Are there any laws for either state that can null and void this policy in regards to me. I'm not an *** I actually brought in more revenue than the my two closesest competeing peers put together. I'm just looking for a way to justify preserveing my vacation so I can have a real vacation later on with some one else covering the area.

In short can a buisness force an employee to use their vacation on a given day instead of letting them use it as they see fit.

can anyone site a case or example so I can use it against the policy and win the day.

I know they won't fire me, and even if they did I'd have a job within three phone calls so lets have it, any case will do so long as I can cite it and force them to be fair. Yahoo answers is awesome.

    American is right. They can set the time and method of work, absent a contract stating otherwise. It is pretty common - lots of people have to take vacation between christmas and new years, e.g.

    your alternatives are to negotiate a better situation if you are truly needed in the region, or to find a new job if the status quo is unacceptable to you.

    but I would not make you r case, if i were you, on how irreplaceable you are as the only person in the region, if you want a "true" vacation later - that would be tantamount ot leaving the region uncovered for an extended period!

    No, they can't require you to use PTO that they've already alloted to you as your own PTO to use when you choose.

    Since you're in a different situation than most of the employees, you could probably call HR and they'll most likely cut you a break.

    Yes, they can.

    If the business is struggling and you can find another job in three phone calls, then I suggest you do that.

    no... you can request the time and if they see fit they can deny you having that time off say if to many employees were booking holiday time off that week but in theory... business's should give you the opportunity to book off the time to suit you and not them...

    yes they can. They can choose when you have off. This is much more common than you think.
