Only if you have some element of damages. Just because they gave you the wrong pills isn't a suit for you, maybe for the state.

No. The mere fact of a mistake is not grounds to sue on. You must suffer damages as a result of the mistake. I am a pharmacist and my brother is a malpractice lawyer I have discussed this with him in detail. There is a famous case in which someone found a rat in a bottle of Coke and sued Coca-Cola. They received nothing as there were no damages incurred as a result of this. If the person had drank the coke and contracted some disease as a result of the rat, then it become another story. Just be happy you caught the mistake and nothing happened as a result. If the public knew all the mistakes doctors made on prescriptions, they would never go to one again. Every day we catch doctors making mistakes on prescriptions and correct them and seldom mention them to the patient.

If you can proove that you had any type of pain/suffering and/or medical care that was needed related directly from taking the wrong medication yes. But if you didn't suffer and you didn't go to the doctor and incur any additional expenses that you would normally not have incurred, then no.

Always check your meds before taking them. Accidents do happen. By not checking the pills yourself, you are also at fault. There is responsibity on both parties here. Be an informed patient as they say.

Yes you do.You expect that a professional pharmacist would know the difference between various medications.

You ,like most of us, entrust your health in the hands of what you expect to be competent professionals.

You have grounds to seek compensation, discuss this with an attorney specializing in medical malpractice . let me also advise you that you also must prove that a s a result of his negligence you sustained health damages
