How do I fight a littering ticket?
I was a passenger riding down the highway (in texas) an threw a tortilla out the window. I didn't see the state trooper on the side of the highway and almost hit his car with it. Needless to say he pulled us over and gave me a littering ticket. I plan on telling the court that I was trying to feed the birds, or at least arguing that it is parishable. Any advice? I'm not getting a lawyer so I don't know what I'll be walking into when I go to the pre-trial tomorrow. Thanks!

The judge is going to laugh at you.
You should have just paid the fine and learned your lesson. Instead you will probably have to pay the court fees in addition to the fine - and you probably won't learn your lesson anyway.

Even if the state trooper was not there you were still littering. He probably let you off lightly because throwing stuff out the window on a highway is very dangerous and can cause accidents and such.
If you were to argue it in court, is to say that it was an accident. Not sure about the driving laws down there but i suppose eating while driving is legal. And the highway spirits magically picked up your tortilla through the window.
But you should more likely just pay the ticket.

You can't really, when the trooper personally witnessed you throw the tortilla. It might have been different if you had stopped the car, accidentally kicked the tortilla out and didn't see it. But if that was the case, he likely would have just given you a warning and allowed you to pick it up. Trying to feed the birds is not going to be a viable defense.

Trying to feed a bird from moving car window? You expect bird to come down to an active roadway to feed? The judge is not going to buy this argument.
It is perishable... yes.... but so as many other form of garbage. That's not going to fly either.
You'd be better off admitting guilt, show remorse, and ask for reduced or suspended penalty. If you try to defend yourself with these silly excuses, the judge will see that you lack judgment and remorse that he will give you the maximum penalty he is allowed.
When you fight in court, what the officer has given you is taken as advise. The judge has the right to discard it, honor it, or give you a whole new charge.

You need to get a legal definition of "litter". If something is biodegradable, is it considered litter. My guess is yes, since I don't think I can dump a bag of rotten tomatoes on the side of the road.

The only way to fight this ticket, would be if you were innocent. You aren't, so now you are compounding the problem. Why not take responsibility for your actions and learn from your mistake?

Don't fight the ticket. You misbehaved and deserve the punishment. To go into the courtroom and suggest anything else would be to commit perjury, and I am sure that you are not the type of person who tries to lie their way out of a situation of their own creation, ......are you?

Look, I wouldn't choose to fight the ticket if I were you. You should be embarrassed that it took a police officer to tell you to take some concern for your community.

haha good luck because your not going to win. From now on, it would be a smart thing to just keep it and throw it away properly instead of trashing the streets.

Apologize to the judge for your action and then quit throwing your trash out the window. Our Mother Earth is not your garbage can.
