I am in the process of being evicted because I couldnt pay the full amount for June...?
I live in California:
They put a 3 day pay or quit letter on my door on 6/10, I still dont have the money.... is there any way I can challenge the eviction policy? Or at least ask for more time if I am evicted?
I dont know what to do, I make to much to apply for finacial aid but I support my mother and cousin and I am the only one in the home working and I have slowly gotten behind to the point of possibly ending up homeless soon.
Any help/advice would be so gratefully taken. Thanks

Hi,
You have a few options you may not have thought of. Do you have anything that you could sell to make the rest of the payment? Can you borrow it from someone? Could you take on a few more hrs. of work to make up that difference. Does your Mom or cousin have the money? The bottom line is your Landlord needs to make the mortgage payment for that property and He/She needs your rent to make their payments, and their priority is to stay solvent or they'll miss their payments too. You do have some time, but you need to do something to get current on your rent. Can your cousin work? Can you cut out some unnecessary things like cable, mag subscriptions, or other things that are just luxuries? If you try hard enough I'm sure you can find the money. The last thing you need is an Eviction on your public record.
Also, I noticed that someone said that it's a pain for Landlord's to do evictions.....that's not true. Some Landlords have the system down pat, and have no problem with this legal maneuver.

Purr, start with the day served and the next day is one. Moreover the LL just wants the rent! If you're on a MTM the LL can do whatever they feel even if you've paid, but if you're on a lease, the LL has to abide by the bylaws of the lease. Frankly, if I were in the LLs shoes, I'd want the rents more then anything, its no fun to file an FED or UD and take all the time to get a tenant out, and make enemies also. Try to work with the LL and with a little sugar, you could be invited in for coffee.

You can appeal the eviction notice. They really are not giving you much of a break since you're not that far behind! Do your best to make an arrangement with the landlordor management. For the long term...you may qualify for assistance if they know you're supporting your mother and sister! Is there any reason they cannot support themselves? If your mother is disabled...she can get disability, and if your sister is under age...she will qualify too. Sounds like you're carrying a lot of responsibility

The three choices available are pay, quit (and likely get a black mark), or stay but later get evicted (and get a really really black mark cause doing eviction is a huge pain in the **** for the LL). There may be other possibilities too. It may help to talk to owner or management. See if you can work or rent difference; they wouldn't be happy about it but who knows.
Most of all, how can you support all these people when you can't pay for your housing. Either think twice about how much you can afford to give to others, or look for much more affordable housing. try housingmaps.com

I think the best thing you can do is ask for more time.
Although you've obviously been in a tough spot for a little while, that doesn't change the fact that you didn't pay rent. Your landlord/property manager might have a heart of gold, but chances are, they don't care about anything but the money.
Why don't your mother and cousin work? I assume they can't, otherwise they probably would, but if one or both of them are capable of getting a job and helping out, it's absolutely absurd that they haven't.

Have you made contact with the landlord? Sometimes if you are honest and tell them the situation they are willing to work with you. It cost the landlord money to evict, so if they are willing and you are willing to make payment arrangements then you should go and talk to them. There is a way to challenge the eviction, you will recieve all that information on the evicton notice that the shriff will post to your door.

Nope. If you are still there, be prepared. They can not just show up with cops and put you on the street and everything inside will be seized and you will not be allowed to not take anything at all. You will have to pay storage fee's for your items since they are now on someone elses property. The second the cops take you out of the house, nothing in the house is yours.
I watched my neighbor go thru this. Both their cars were in the garage and they were not allowed to remove the cars either. It was now property of the owner of the home. They were only allowed to get their items out in one shot, a three hour period, with owners and cops present. If you do not get it all out, it is legally their's to do with forever!

If you are supporting more people than just yourself, then there should be a way to get more help.
You can challenge it, and you have 30 days (in most cases) to get out..... so, when/if you have to go to court, bring this up.

The best thing to do is talk to the management of the apartments and try to work out payment. Do that asap!
