I need to know my rights in regards to the purchase of a used car...?

I live in Kansas and I recently purchased a used vehicle. When I went to put gas in the tank, gas gushed all over the place. I did not have the vehicle inspected before the purchase but I am wondering if there is a law or if I have the right to return the vehicle and cancel my purchase? I will have the vehicle in my possession for 3 days tommorow.

    No return on car sales.More than likely it was sold as is which means no warranty unless you have paper work that says you have a warranty. There is no cooling off period . Lemon laws only apply to new cars. If you bought it from a dealer he may help you. If you bought it from a individual its as is. Only thing you can do if the dealer wont help is to just fix it and move on. Or if it becomes to expensive to fix or maintain is sell it and learn a lesson for next time...............UJN

    I'm not sure about Kansas, but some states have a period where you can cancel a contract on a major purchase such as a car or major home repairs. It depends on the state, but the time is usually somewhere between 2 days and 5 days, and typically, this only includes BUSINESS days, Sunday not being counted. There are also lemon laws, but they would not kick in for this car since it is used and they are almost always sold "as-is".

    I include a link to a site that talks about this and indicates Kansas does not have a cancellation law, but I would still take it to the car lot and talk to them.

    One other thing, are you sure the problem was with the car and not the gas pump? If fuel was leaking from the car due to a defect, I wouldn't expect to hear it described as "gushed". I have had fuel gush out if the automatic fuel cut-off in the pump wasn't working or if I didn't have the pump nozzle in the fuel opening correctly. Just something to consider.

    (If you purchased from a dealer, you can go back, and ask them what is going on, and ask for assistance - but I don't believe they are under any legal obligation to take back the car)
