Problems with recieving child support?
My daughter lives with me in calif. my ex lives in wisconsin. My mom lives in texas. here is the story... child support is taken out of my ex's check and it is sent to texas to my mom and she never sends it to me here in california and it belongs to my daughter. she claims she has custody over my daughter. she told the state of texas she has custody, but really she does not. i tried to collect child support for her in state of calif and they said someone else is collecting her child support...(my mom in texas) well....i have not recieved any check what so ever. yes any. one of the checks was for $1,450.00!! it makes me wonder what my mom is doing with all this money. i am broke here what would any f you do? how do I legally change this? this seems so sticky of a situation.
why would my mom say she has custody when she doesnt ? is she doing this so she can collect money ? she knows we my daughter and i struggle here but still she wont hand over the child support money. why?
nicky, if i knew i would not be asking!!! and the only reason i can think of is that she lies alot. but this is down right cruel and basically stealing!! why would someone fake that? my ex evn knows she is doing this but legally he does not know what to do. we do not know tx laws etc...etc...

Go to Texas and lawyer up. If your mom doesn't have legal custody, she's in trouble because that sounds like fraud.

Okay, what you need to do is go to the local court house where this case was initially opened up. You have the right to access your own file. Make copies of everything in there and read through ALL of them. Find out who has custody (legally). Because regardless, if the child is in your care and your mother has legal custody then YOU are in a mess and need to file immediately to get this squared away.
The main priority is that whomever is the child’s legal guardian, with that child in their care, is who should be collecting child support. Period! So meet with a lawyer, call your clerk of courts, child support enforcement, whomever you need to talk to, and get to the bottom of this. I do NOT suggest going through your mother or any other person. Do this yourself. Find out yourself. And figure this out on your own.

Not to mention, whomever is collecting and knowingly doesn't have the kids in their care...that's fraudulent activity towards Child Support Enforcement. They won't like that too much...

Legally undertake him. Ask the organic father to terminate his parental rights, agree in courtroom to forgive all rears and all long run baby aid repayments, and undertake the boy. A courtroom of regulation loves to have a "father" earlier than they sever baby aid responsibilities.
