I was caught speeding this morning. However, I am going to fight it. The reason why is posted later.?
I was following approx 300 meters behind another truck that was travelling about 80 into a 60km/hr construction zone. I enetered the construction zone at 92 and slowed to 89 holding that speed the entire way behind the first truck that entered. During this time a vehicle approached from the rear and as we exited the construction zone it was a CVSE(Commervial Vehicle) Officer who gave me the ticket for speeding. I am going to defend myself for 2 reasons. #1 the law of posted speed limits is absolute. (Essentially the first truck that passed the speed limit sign broke the law and he should have been stopped). #2. I recorded the officer on digital camera in movie mode admitting that the first truck was going fast and that he couldn't stop us both. (remember I was the 2nd truck) What is your thought on this and does anyone have any previous experience with this type of ticket....being the second speeder? Would you fight it if you had video proof that you are not the first to speed past him

Been there, done that. The judge ruled with the policeman. Sux for sure!

It doesn't matter who was first. He caught you. You were speeding. You will pay the fine. No judge is going to let you off. You did the crime so you have to do the time. The cop was right that he couldn't stop both of you so you got chosen. It doesn't matter that the other truck was wrong too. It only matters that you were wrong since you are the one he caught. Just because the first truck was speeding, it doesn't mean that you can do it too. Don't waste your time and money fighting it.

You won't win just because you say someone else was wrong too!! You will lose this case. You were speeding, the officer can only stop one person and you were it. Your video does nothing. I would see if you can do something to avoid points on your license, like traffic school (if it's available where you live). Learn your lesson and the fact that just because someone else does it, doesn't make it right!!!

Don't bother appealing, you don't have a case.
You broke the law, the cop caught you. That he didn't catch someone else has nothing to do with it.
