When does the Courts considers a missing person legally dead?

Is that a collective or individual State decision?

    Individual state decisions but for most part I don't think that some states will consider a missing person dead without proof. If someone leaves their spouse and don't come back they are legally divorced by law all the person has to do is the paper work on that but this isn't the same thing and I know someone who has been missing for yrs and they told them she will remain on the missing list until the either find her or know she is dead via a jane doe unidentified person that turns up with dna and other matches to prove it was her type things

    After 7 years with no sign of the person, they're considered legally dead.

    It's a Court Decision.

    Pretty much a universal standard.

    They can only assume a person to be deceased after they have gone missing. The only time they can legally consider someone to be dead if they have been found and legally pronounced.
