Possession of property? Can he take our horses?

definition I found says: "go to court to recover specific goods the creditor is saying you have wrongfully take or kept. Creditor's rights depend on his right to possess specific goods named in his suit at the time he files suit to possess the property and not who owns the property."

So the owner of the pasture kicked us out and we took just our horses, the hot wire fence, hot wire fence posts, our horse trailer, our round pen, and our gate. Can he get our horses? He doesn't want to give us time to make arrangements to pay him something I don't think I owe him, but wants it now and isn't willing to wait until the end of sept. (which he will have to anyway if he files) He even went to myhusbands job demanding his money and then told my husband that he would see him in court and that my husband would have to pay the court fees. He didn't even let my husband explain that we we finacially stressed because he kicked us out at such short notice.

    It depends how much is he sueing you for? He may be able to get the horses(if he wins the auction) post-judgment if you do not pay the judgment, provided that he wins a judgment.

    Depends entirely on the laws of the state where this happened. Every state has different laws on this subject.
